PAG LIN 1 1 Amend Senate File 503 as follows: 1 2 #1. Page 7, by inserting after line 15 the 1 3 following: 1 4 "Sec. ___. Section 904.705, unnumbered paragraph 1 5 2, Code 1997, is amended to read as follows: 1 6 The directormayshall with the assistance of the 1 7 department of natural resources establish and operate 1 8 forestry nurseries on state-owned land under the 1 9 control of the department. Residents of the adult 1 10 correctional institutions shall provide the labor for 1 11 the operation. Nursery stock shall be sold in 1 12 accordance with the rules of the natural resource 1 13 commission. The department shall pay the costs of 1 14 establishing and operating the forestry nurseries out 1 15 of the revolving farm fund created in section 904.706. 1 16 The department of natural resources shall pay the 1 17 costs of transporting, sorting, and distributing 1 18 nursery stock to and from or on state-owned land under 1 19 the control of the department of natural resources. 1 20 Receipts from the sale of nursery stock produced under 1 21 this section shall be divided between the department 1 22 and the department of natural resources in direct 1 23 proportion to their respective costs as a percentage 1 24 of the total costs. The department shall deposit its 1 25 receipts in the revolving farm fund created in section 1 26 904.706. 1 27 Sec. ___. Section 904.706, unnumbered paragraph 1, 1 28 Code 1997, is amended to read as follows: 1 29 A revolving farm fund is created in the state 1 30 treasury in which the department shall deposit 1 31 receipts from agricultural products, nursery stock, 1 32 agricultural land rentals, and the sale of livestock. 1 33However, beforeBefore any agricultural operation is 1 34 phased out, the department which proposes to 1 35 discontinue this operation shall notify and receive 1 36 the permission of the governor, chairpersons and 1 37 ranking members of the house and senate appropriations 1 38 committees, and cochairpersons and ranking members of 1 39 the subcommittee in the senate and house of 1 40 representatives which has handled the appropriation 1 41 for this department in the past session of the general 1 42 assembly. Before the department sells farmland under 1 43 the control of the department, the director shall 1 44 notify and receive the permission of the governor, 1 45 chairpersons and ranking members of the house and 1 46 senate appropriations committees, and cochairpersons 1 47 and ranking members of the joint appropriations 1 48 subcommittee that handled the appropriation for the 1 49 department during the past session of the general 1 50 assembly. No sale or discontinuance of operations 2 1 shall cause the level of activity or inmate 2 2 participation to fall below the level of activity or 2 3 participation which was in effect on January 1, 1997. 2 4 The department may pay from the fund for the 2 5 operation, maintenance, and improvement of farms and 2 6 agricultural or nursery property under the control of 2 7 the department. A purchase order for five thousand 2 8 dollars or less payable from the fund is exempt from 2 9 the general purchasing requirements of chapter 18. 2 10 Notwithstanding section 8.33, unencumbered or 2 11 unobligated receipts in the revolving farm fund at the 2 12 end of a fiscal year shall not revert to the general 2 13 fund of the state." 2 14 #2.
