1 1 Section 1. Section 368.7, subsection 2, Code 1997, is
1 2 amended to read as follows:
1 3 2. An application for annexation of territory not within
1 4 an urbanized area of a city other than the city to which the
1 5 annexation is directed must be approved by resolution of the
1 6 council which receives the application. Notice of the
1 7 application shall be published in an official county newspaper
1 8 in each county which contains a portion of the territory at
1 9 least ten days before any action is taken by the city council
1 10 on the application. In the discretion of a city council, the
1 11 resolution may include a provision for a transition for the
1 12 imposition of taxes as provided in section 368.11, subsection
1 13 13. Upon receiving approval of the council, the city clerk
1 14 shall file a copy of the resolution, map, and legal
1 15 description of the territory involved with the secretary of
1 16 state, county board of supervisors, each affected public
1 17 utility, and the state department of transportation. The city
1 18 clerk shall also record a copy of the legal description, map,
1 19 and resolution with the county recorder. The secretary of
1 20 state shall not accept and acknowledge a copy of a legal
1 21 description, map, and resolution of annexation which would
1 22 create an island. The annexation is completed upon
1 23 acknowledgment by the secretary of state that the secretary of
1 24 state has received the legal description, map, and resolution.
1 25 EXPLANATION
1 26 This bill provides that an application for annexation of
1 27 territory not within an urbanized area of a city other than
1 28 the city to which the annexation is directed shall not be
1 29 approved by the city council without notice of the application
1 30 being published in an official county newspaper in each county
1 31 which contains a portion of the territory at least 10 days
1 32 before any action is taken on the application.
