1 1 Section 1. Section 552.1, subsection 3, Code 1997, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. f. A facility owned and operated on a not-
1 4 for-profit basis by a person or a contractor of a person that
1 5 is operated solely for the purpose of serving employees of the
1 6 person, whether currently employed or retired, and family
1 7 members of employees.
1 8 EXPLANATION
1 9 This bill excludes from the definition of "physical
1 10 exercise club" a facility owned and operated on a not-for-
1 11 profit basis by a person or contractor of a person if operated
1 12 solely for the purpose of serving employees and family members
1 13 of the employees. The result of this exclusion is to make the
1 14 various requirements which relate to physical exercise clubs
1 15 such as requirements relating to contracts with members,
1 16 membership contract cancellation requirements, and
1 17 registration of the club with the attorney general's consumer
1 18 protection division inapplicable to such facilities.
