  1  1    Section 1.  Section 455B.307A, subsections 2 and 3, Code
  1  2 1997, are amended to read as follows:
  1  3    2.  A person shall not discard or direct another person to
  1  4 discard solid waste onto or in any water or land of the state,
  1  5 onto private property, or into areas or receptacles provided
  1  6 for such purposes which are under the control of or used by a
  1  7 person who has not authorized the use of the receptacle by the
  1  8 person discarding or directing the discarding of the solid
  1  9 waste.
  1 10    3.  A person who violates this section is subject to a
  1 11 civil penalty not to exceed five hundred dollars for each
  1 12 violation commits a serious misdemeanor and, notwithstanding
  1 13 section 903.1, the maximum fine shall be five hundred dollars
  1 14 in addition to the costs associated with the cleanup of the
  1 15 violation.  All payments of fines and costs imposed for a
  1 16 violation of this section shall be distributed to the county
  1 17 in which the violation occurred, notwithstanding sections
  1 18 602.8106 and 602.8108.  
  1 19                           EXPLANATION
  1 20    This bill amends Code section 455B.307A which currently
  1 21 prohibits the discarding of solid waste onto or in any water
  1 22 or land of the state, or the unauthorized discarding of solid
  1 23 waste into other areas or receptacles.  Under the current law,
  1 24 a person violating the section is subject to a civil penalty
  1 25 for each violation.
  1 26    The bill adds private property as a location on which solid
  1 27 waste shall not be discarded.  The bill provides that a person
  1 28 who violates the section or a person who directs another
  1 29 person to violate the section commits a serious misdemeanor
  1 30 punishable by a fine of $500 in addition to the costs
  1 31 associated with the cleanup of the violation.  The bill
  1 32 provides that fines and costs are to be paid to the counties
  1 33 in which the violations occur.
