  1  1    Section 1.  Section 261C.6, Code 1997, is amended to read
  1  2 as follows:
  1  3    261C.6  SCHOOL DISTRICT PAYMENTS.
  1  4    Not later than June 30 of each year, a school district
  1  5 shall pay a tuition reimbursement amount to an eligible
  1  6 postsecondary institution that has enrolled its resident
  1  7 eligible pupils under this chapter.  For pupils enrolled at
  1  8 the school for the deaf and the Iowa braille and sight saving
  1  9 school, the state board of regents shall pay a tuition
  1 10 reimbursement amount by June 30 of each year.  The amount of
  1 11 tuition reimbursement for each separate course shall equal
  1 12 two-thirds of the lesser of:
  1 13    1.  The actual and customary costs of tuition, textbooks,
  1 14 materials, and fees directly related to the course taken by
  1 15 the eligible student.
  1 16    2.  Two Three hundred fifty dollars.
  1 17    A pupil is not eligible to enroll on a full-time basis in
  1 18 an eligible postsecondary institution and receive payment for
  1 19 all courses in which a student is enrolled.
  1 20    Sec. 2.  NEW SECTION.  261C.10  SUBMISSION AND PAYMENT OF
  1 21 CLAIMS FOR STATE REIMBURSEMENT.
  1 22    1.  The boards of directors of school districts required to
  1 23 pay a tuition reimbursement amount as provided in section
  1 24 261C.6 shall submit claims for reimbursement to the department
  1 25 of education by January 31 and July 15 of each school year,
  1 26 accompanied by an affidavit of an officer of the public school
  1 27 district affirming the accuracy of the claim.  The department
  1 28 of education shall certify to the department of revenue and
  1 29 finance the amounts of approved claims to be paid, and the
  1 30 department of revenue and finance shall draw warrants payable
  1 31 to school districts that have established claims.  The claim
  1 32 shall be submitted on a form prescribed by the department, and
  1 33 the claim shall state the high school academic or vocational-
  1 34 technical credit granted to an eligible pupil enrolled in a
  1 35 course under this chapter if the eligible pupil successfully
  2  1 completes the course as determined by the eligible
  2  2 institution.
  2  3    2.  There is appropriated from the general fund of the
  2  4 state to the department of education funds sufficient to pay
  2  5 the approved claims of public school districts as provided in
  2  6 this section.  The amount paid for an approved claim under
  2  7 this subsection shall be one-half of the tuition reimbursement
  2  8 amount paid by the district to an eligible postsecondary
  2  9 institution that has enrolled eligible pupils under this
  2 10 chapter pursuant to section 261C.6.
  2 11    3.  There is appropriated from the general fund of the
  2 12 state to the state board of regents funds sufficient to pay
  2 13 one-half of the tuition reimbursement amount paid by the state
  2 14 board of regents pursuant to section 261C.6.
  2 15    4.  The costs of paying a tuition reimbursement amount to
  2 16 an eligible postsecondary institution that has enrolled a
  2 17 school district's resident eligible pupils under this chapter
  2 18 pursuant to section 261C.6 shall not be included in the
  2 19 computation of district cost under chapter 257, but shall be
  2 20 shown in the budget as an expense from miscellaneous income.
  2 21 State reimbursements received by a school district for tuition
  2 22 reimbursement shall not affect district cost limitations of
  2 23 chapter 257.  The reimbursements provided in this section are
  2 24 miscellaneous income as defined in section 257.2.
  2 25    5.  If a school district or the state board of regents is
  2 26 reimbursed for its tuition reimbursement costs directly
  2 27 related to a course enrolled in but not completed by a pupil
  2 28 in accordance with section 261C.8, the district, or the state
  2 29 board of regents if applicable, is ineligible to receive a
  2 30 reimbursement under this section.  
  2 31                           EXPLANATION
  2 32    This bill provides that the state shall be responsible for
  2 33 one-third of the costs of the postsecondary enrollment options
  2 34 Act.
  2 35    Currently, school districts and the state board of regents
  3  1 are required to pay a tuition reimbursement amount of up to
  3  2 $250 per course to an eligible postsecondary institution that
  3  3 has enrolled its resident eligible pupils under the Act.  The
  3  4 state board of regents' pupils eligible for the Act are those
  3  5 enrolled at the school for the deaf and the Iowa braille and
  3  6 sight saving school.
  3  7    The bill appropriates to the department of education and to
  3  8 the regents an amount sufficient to pay reimbursement of up to
  3  9 $100 for each separate course taken by a pupil under the Act.
