  1  1    Section 1.  NEW SECTION.  279.14A  TEACHING PERFORMANCE
  1  2 ASSISTANCE PROGRAM.
  1  3    1.  If the general assembly appropriates moneys for the
  1  4 establishment and ongoing administration of a regional
  1  5 teaching technical assistance system, the department of
  1  6 education shall establish and implement a regional system to
  1  7 provide technical assistance to each public school district
  1  8 and area education agency for the development and
  1  9 implementation of a plan of assistance to teachers who are
  1 10 performing inadequately.  The department shall consult with
  1 11 the Iowa state education association, the Iowa association of
  1 12 school boards, and the school administrators of Iowa in
  1 13 developing the system.
  1 14    2.  The department of education shall establish model
  1 15 evaluation criteria for teacher performance and a model
  1 16 assistance plan a school district may implement to assist
  1 17 teachers who are performing inadequately.  Evaluation criteria
  1 18 developed by the department may be used by a district as
  1 19 specified in section 279.14.  The board of directors of a
  1 20 school district shall adopt an assistance plan for teachers
  1 21 employed by the district who are performing inadequately.  The
  1 22 district plan shall include, at a minimum, the following:
  1 23    a.  Criteria for teachers in areas such as instruction,
  1 24 communication, and classroom environment and management.
  1 25    b.  Adequate notification procedures for failure to meet
  1 26 criteria.
  1 27    c.  Measures to provide assistance and resources for
  1 28 improvement.
  1 29    d.  A reasonable, specified amount of time for a teacher to
  1 30 show improvement.
  1 31    e.  Consequences for failure to meet expectations, up to
  1 32 and including termination of contract.
  1 33    3.  Moneys received under this section by a school district
  1 34 shall be expended to provide training in the areas of policy
  1 35 and procedures, development of district and area education
  2  1 agency plans of assistance, and coordination of trained
  2  2 individuals to serve on intensive assistance teams for
  2  3 teachers performing inadequately.  Support is to be provided
  2  4 through regional coordinators for the provision of training
  2  5 and expertise in the areas of assistance and termination
  2  6 provided for in section 279.15.  Training may be coordinated
  2  7 with the evaluator training for district administrators
  2  8 required under section 279.14B, and shall be made available to
  2  9 local school districts and area education agencies.  Training
  2 10 shall also be provided to individuals serving on regional
  2 11 assistance teams.  The regional system may coordinate or
  2 12 assist in the coordination of an assistance team that would be
  2 13 provided to a school district or area education agency upon
  2 14 receipt of a request for assistance which presents
  2 15 satisfactory documentation of inadequate teacher performance
  2 16 based on established criteria.
  2 17    4.  The use of the regional system of assistance
  2 18 established under this section is not a prerequisite to use of
  2 19 the termination procedures provided under section 279.15.
  2 20    5.  This section does not apply to a person discharged
  2 21 under section 279.27.
  2 22    Sec. 2.  NEW SECTION.  279.14B  ADMINISTRATOR PERFORMANCE
  2 23 ASSISTANCE PROGRAM.
  2 24    1.  If the general assembly appropriates moneys for the
  2 25 establishment and ongoing administration of a regional
  2 26 administration technical assistance system, the department of
  2 27 education shall establish and implement a regional system to
  2 28 provide technical assistance to each public school district
  2 29 and area education agency for the development and
  2 30 implementation of a plan of assistance to administrators who
  2 31 are performing inadequately.  The department shall consult
  2 32 with the Iowa state education association, school
  2 33 administrators of Iowa, and the Iowa association of school
  2 34 boards in developing the system.
  2 35    2.  The department of education shall establish model
  3  1 evaluation criteria for administrator performance and a model
  3  2 assistance plan a school district may implement to assist
  3  3 administrators who are performing inadequately.  Evaluation
  3  4 criteria developed by the department may be used by a district
  3  5 as specified in section 279.23A.  The board of directors of a
  3  6 school district shall adopt an assistance plan for
  3  7 administrators employed by the district who are performing
  3  8 inadequately.  The district plan shall include, at a minimum,
  3  9 the following:
  3 10    a.  Criteria for administrators in areas such as school and
  3 11 district environment, maintenance and promotion of effective
  3 12 programs, effective management, and communication and
  3 13 collaboration with staff, parents, and community.
  3 14    b.  Adequate notification procedures for failure to meet
  3 15 criteria.
  3 16    c.  Measures to provide assistance and resources for
  3 17 improvement.
  3 18    d.  A reasonable, specified amount of time for an
  3 19 administrator to show improvement.
  3 20    e.  Consequences for failure to meet expectations, up to
  3 21 and including termination of contract.
  3 22    3.  Moneys received under this section by a school district
  3 23 shall be expended to provide training in the areas of policy
  3 24 and procedures, development of district and area education
  3 25 agency plans of assistance, and coordination of trained
  3 26 individuals to serve on intensive assistance teams for
  3 27 administrators performing inadequately.  Support is to be
  3 28 provided through regional coordinators for the provision of
  3 29 training and expertise in the areas of assistance and
  3 30 termination provided for in section 279.24.  Training may be
  3 31 coordinated with the evaluator training for teachers required
  3 32 under section 279.14A, and shall be made available to local
  3 33 school districts and area education agencies.  Training shall
  3 34 also be provided to individuals serving on regional assistance
  3 35 teams.  The regional system may coordinate or assist in the
  4  1 coordination of an assistance team that would be provided to a
  4  2 school district or area education agency upon receipt of a
  4  3 request for assistance which presents satisfactory
  4  4 documentation of inadequate administrator performance based on
  4  5 established criteria.
  4  6    4.  The use of the regional system of assistance
  4  7 established under this section is not a prerequisite to the
  4  8 use of the termination procedures provided under section
  4  9 279.24.
  4 10    5.  This section does not apply to a person discharged
  4 11 under section 279.25.  
  4 12                           EXPLANATION 
  4 13    This bill, subject to an appropriation by the general
  4 14 assembly, requires the department of education to establish
  4 15 regional systems to provide technical assistance to each
  4 16 public school district and area education agency for the
  4 17 development and implementation of a plan of assistance to
  4 18 teachers and administrators determined to be performing the
  4 19 duties of teaching or administration inadequately.  Under the
  4 20 systems, the department is to establish model evaluation
  4 21 criteria for teacher and administrator performance and a model
  4 22 assistance plan that may be used by school districts.  School
  4 23 districts are required under the bill to adopt an assistance
  4 24 plan for teachers and administrators who are performing
  4 25 inadequately.  The bill lists the minimum criteria each
  4 26 district plan is required to include.  The bill also provides
  4 27 that funds are to be expended to provide training in specified
  4 28 areas, the development of plans of assistance, and
  4 29 coordination of intensive assistance teams.
