PAG LIN 1 1 Section 1. Section 904A.1, Code 1997, is amended to read 1 2 as follows: 1 3 904A.1 BOARD OF PAROLE. 1 4 The board of parole is created to consist of five members. 1 5 Each member, except the chairperson and the vice chairperson, 1 6 shall be compensated on a day-to-day basis. Each member shall 1 7 serve a term of four years beginning and ending as provided by 1 8 section 69.19, except for members appointed to fill vacancies 1 9 who shall serve for the balance of the unexpired term. The 1 10 terms shall be staggered. The chairperson and vice 1 11 chairperson of the board shall beafull-time, salariedmember1 12 members of the board. A majority of the members of the board 1 13 constitutes a quorum to transact business. 1 14 Sec. 2. Section 904A.4A, Code 1997, is amended by adding 1 15 the following new subsection: 1 16 NEW SUBSECTION. 7. Appoint a member of the board of 1 17 parole to serve as vice chairperson and determine the duties 1 18 of the vice chairperson. 1 19 Sec. 3. NEW SECTION. 904A.4C VICE CHAIRPERSON OF THE 1 20 BOARD OF PAROLE. 1 21 The vice chairperson of the board of parole shall be 1 22 appointed from the membership of the board of parole by the 1 23 chairperson. The vice chairperson shall serve at the pleasure 1 24 of the chairperson and shall have such responsibilities and 1 25 duties as are determined by the chairperson. The vice 1 26 chairperson shall act as the chairperson in the absence or 1 27 disability of the chairperson or in the event of a vacancy in 1 28 that office, until such time as a new chairperson is appointed 1 29 by the governor. 1 30 Sec. 4. Section 904A.6, Code 1997, is amended to read as 1 31 follows: 1 32 904A.6 SALARIES AND EXPENSES. 1 33 Each member, except the chairperson and the vice 1 34 chairperson, of the board shall be paid per diem as determined 1 35 by the general assembly. The chairperson and vice chairperson 2 1 of the board shall be paid a salary as determined by the 2 2 general assembly. Each member of the board and all employees 2 3 are entitled to receive, in addition to their per diem or 2 4 salary, their necessary maintenance and travel expenses while 2 5 engaged in official business. 2 6 Sec. 5. EFFECTIVE DATE. This Act takes effect May 1, 2 7 1998. 2 8 EXPLANATION 2 9 This bill provides for the appointment of a vice 2 10 chairperson of the board of parole. The vice chairperson is 2 11 to be appointed by the chairperson of the board of parole and 2 12 serves at the pleasure of the chairperson. The chairperson of 2 13 the board is also to determine the duties to be performed by 2 14 the vice chairperson of the board. The position of vice 2 15 chairperson is, like the position of chairperson, a salaried 2 16 position. The amount of the salary of the vice chairperson, 2 17 like the salary of the chairperson, is to be determined by the 2 18 general assembly. The vice chairperson is to assume the 2 19 duties of the chairperson in the absence or disability of the 2 20 chairperson or in the event of a vacancy in the office of 2 21 chairperson, until the governor appoints a replacement 2 22 chairperson.
