PAG LIN 1 1 Section 1. Section 237A.1, subsections 3 and 8, Code 1997, 1 2 are amended to read as follows: 1 3 3. "Child care center" or "center" means a facility 1 4 providing child day care forseveneight or more children, 1 5 except when the facility is registered as a family day care 1 6 home or group day care home. 1 7 8. a. "Family day care home" means a person or program 1 8 which provides child day care to less thanseveneight 1 9 children at any one time or to less thantwelvefourteen 1 10 children at any one time as authorized by section 237A.3, 1 11 subsection 1. 1 12 b. "Group day care home" means a facility providing child 1 13 day care for more thansixseven but less thantwelvefourteen 1 14 children, or for less thansixteeneighteen children at any 1 15 one time as authorized in accordance with section 237A.3, 1 16 subsection 3, provided each child in excess ofsixseven 1 17 children is attending school in kindergarten or a higher grade 1 18 level. 1 19 Sec. 2. Section 237A.2, unnumbered paragraph 2, Code 1997, 1 20 is amended to read as follows: 1 21 A person denied a license under the provisions of this 1 22 section shall receive written notice of the denial stating the 1 23 reasons for denial and shall be provided with an opportunity 1 24 for an evidentiary hearing. Licenses granted under this 1 25 chapter shall be valid for one year from the date of issuance 1 26 unless revoked or suspended in accordance with the provisions 1 27 of section 237A.8. A record of the license shall be kept by 1 28 the department. The license shall be posted in a conspicuous 1 29 place in the center and shall state the particular premises in 1 30 which child day care may be offered and the number of 1 31 individuals who may be received for care at any one time.No1 32 PARAGRAPH DIVIDED. A greater number of children than is 1 33 authorized by the license shall not be kept in the center at 1 34 any one time. However, the center may provide care for up to 1 35 thirty percent more children than the number authorized by the 2 1 license during a day with inclement weather following the 2 2 cancellation of school classes, if the center has prior 2 3 written approval from the parent or guardian of each child 2 4 present concerning the presence of the excess number of 2 5 children, and if each child present in the center in excess of 2 6 the number authorized either would be unattended if the child 2 7 were not present in the center or that child's sibling is 2 8 regularly provided care by the center. 2 9 Sec. 3. Section 237A.3, subsection 1, paragraph b, Code 2 10 1997, is amended to read as follows: 2 11 b. No greater number of children than is authorized by the 2 12 registration certificate shall be kept in the family day care 2 13 home at any one time. However, a registered or unregistered 2 14 family day care home may provide care for more thansixseven 2 15 but less thantwelvefourteen children at any one time for a 2 16 period of less than two hours, provided that each child in 2 17 excess ofsixseven children is attending school in 2 18 kindergarten or a higher grade level. 2 19 Sec. 4. Section 237A.3, subsection 1, paragraph c, 2 20 unnumbered paragraph 1, Code 1997, is amended to read as 2 21 follows: 2 22 A family day care home may provide care in accordance with 2 23 this subsection for more thansixseven but less thantwelve2 24 fourteen children for two hours or more during a day with 2 25 inclement weather following the cancellation of school 2 26 classes. The home must have prior written approval from the 2 27 parent or guardian of each child present in the home 2 28 concerning the presence of excess children in the home 2 29 pursuant to this paragraph. The home must have a responsible 2 30 individual, age fourteen or older, on duty to assist the home 2 31 provider when more thansixseven children are present in 2 32 accordance with the provisions of this paragraph. In 2 33 addition, one or more of the following conditions shall apply 2 34 to each child present in the home in excess ofsixseven 2 35 children: 3 1 Sec. 5. Section 237A.3, subsection 1, Code 1997, is 3 2 amended by adding the following new paragraph: 3 3 NEW PARAGRAPH. dd. A family or group day care home shall 3 4 not have more than four children present at any one time who 3 5 are less than two years of age. 3 6 Sec. 6. Section 237A.3, subsection 2, Code 1997, is 3 7 amended to read as follows: 3 8 2. A person shall not operate or establish a group day 3 9 care home unless the person obtains a certificate of 3 10 registration under this chapter. In order to be registered, 3 11 the group day care home shall have at least one responsible 3 12 individual, age fourteen or older, on duty to assist the group 3 13 day care home provider when there are more thansixseven 3 14 children present for more than a two-hour period. All other 3 15 requirements of this chapter for registered family day care 3 16 homes and the rules adopted under this chapter for registered 3 17 family day care homes apply to group day care homes. In 3 18 addition, the department shall adopt rules relating to the 3 19 provision in group day care homes for a separate area for sick 3 20 children. In consultation with the state fire marshal, the 3 21 department shall adopt rules relating to the provision of fire 3 22 extinguishers, smoke detectors, and two exits accessible to 3 23 children. 3 24 Sec. 7. Section 237A.3, subsection 3, unnumbered paragraph 3 25 1, Code 1997, is amended to read as follows: 3 26 A registered group day care home may provide care in 3 27 accordance with this subsection for more thaneleventhirteen 3 28 but less thansixteeneighteen children for a period of less 3 29 than two hours or for a period of two hours or more during a 3 30 day with inclement weather following the cancellation of 3 31 school classes. The home must have the prior written approval 3 32 from the parent or guardian of each child present in the home 3 33 concerning the presence of excess children in the home. In 3 34 addition, one or more of the following conditions shall apply 3 35 to each child present in the home in excess ofeleventhirteen 4 1 children during a period of inclement weather: 4 2 EXPLANATION 4 3 This bill relates to the number of children authorized for 4 4 child day care providers. 4 5 The bill amends Code section 237A.2 to allow a child care 4 6 center to provide care for up to 30 percent above the maximum 4 7 authorized for the center during a day with inclement weather 4 8 following the cancellation of school classes. The center must 4 9 have the written approval of the parents of the children 4 10 receiving care concerning the presence of the excess number of 4 11 children. In addition, other conditions apply to the extra 4 12 children. 4 13 Family day care homes are authorized to increase the number 4 14 of full-time children which may be cared for at one time by 4 15 one child, increasing from six to seven. In addition, the 4 16 number of school age children in excess of seven children 4 17 which may receive care for a period of two hours or less is 4 18 increased by two from five to seven. Similar increases are 4 19 authorized during a period of inclement weather when the 4 20 number of children which may receive care for more than two 4 21 hours is increased from less than 12 to less than 14. A new 4 22 paragraph limits the number of children who are less than two 4 23 years of age who may be present in a family or group day care 4 24 home to not more than four children. 4 25 For both family and group day care homes, the number of 4 26 children beyond which an assistant is required is increased 4 27 from more than six to more than seven children. 4 28 An increase in the number of children is also authorized 4 29 for group day care homes in the same amount as is authorized 4 30 for family day care homes.
