  1  1    Section 1.  Section 321.1, subsection 76, Code 1997, is
  1  2 amended to read as follows:
  1  3    76.  "Special truck" means a motor truck or truck tractor
  1  4 not used for hire with a gross weight registration of six
  1  5 through thirty-two forty tons used by a person engaged in
  1  6 farming to transport commodities produced only by the owner,
  1  7 or to transport commodities purchased by the owner for use in
  1  8 the owner's own farming operation, or for occasional use for
  1  9 charitable purposes.  "Special truck" also means a motor truck
  1 10 or truck tractor not used for hire with a gross weight
  1 11 registration of six through thirty-two tons used by a person
  1 12 engaged in farming who assists, or to assist another person
  1 13 engaged in farming through an exchange of services.  A
  1 14 "special truck" does not include a truck tractor operated more
  1 15 than seventy-five hundred miles annually.
  1 16    Sec. 2.  Section 321.121, unnumbered paragraph 1, Code
  1 17 1997, is amended to read as follows:
  1 18    The registration fee for a special truck shall be eighty
  1 19 dollars for a gross weight of six tons, one hundred dollars
  1 20 for a gross weight of seven tons, one hundred twenty dollars
  1 21 for a gross weight of eight tons, and in addition, fifteen
  1 22 dollars for each ton over eight tons and not exceeding
  1 23 eighteen tons.  The registration fee for a special truck with
  1 24 a gross weight registration exceeding eighteen tons but not
  1 25 exceeding nineteen tons shall be three hundred twenty-five
  1 26 dollars and for a gross weight registration exceeding nineteen
  1 27 tons but not exceeding twenty tons the registration fee shall
  1 28 be three hundred seventy-five dollars.  The additional
  1 29 registration fee for a special truck for a gross weight
  1 30 registration in excess of twenty tons is twenty-five dollars
  1 31 for each ton over twenty tons and not exceeding thirty-two
  1 32 forty tons.
  1 33    Sec. 3.  Section 321.466, subsection 5, Code 1997, is
  1 34 amended to read as follows:
  1 35    5.  It shall be unlawful for any person to operate a motor
  2  1 truck, trailer, truck tractor, road tractor, semitrailer or
  2  2 combination thereof, or any such vehicle equipped with a
  2  3 transferable auxiliary axle or axles, on the public highways
  2  4 with a gross weight exceeding that for which it is registered
  2  5 by more than five percent of the gross weight for which it is
  2  6 registered, provided, however, that any vehicle or vehicle
  2  7 combination referred to herein, while carrying a load of raw
  2  8 farm products, soil fertilizers, including ground limestone,
  2  9 raw dairy products or livestock, live poultry, eggs, may be
  2 10 operated with a gross weight of twenty-five percent in excess
  2 11 of the gross weight for which it is registered but not to
  2 12 exceed a maximum gross weight of eighty thousand pounds.  
  2 13                           EXPLANATION
  2 14    This bill increases the gross weight for special trucks
  2 15 from a maximum of 32 tons to a maximum of 40 tons.  A special
  2 16 truck is a motor truck or truck tractor not used for hire by a
  2 17 person engaged in farming to transport commodities produced
  2 18 only by the owner, or to transport commodities purchased by
  2 19 the owner for use in the owner's own farming operation or
  2 20 occasional use for charitable purposes, or to assist another
  2 21 person engaged in farming through an exchange of services.
  2 22 The registration fee for special trucks in excess of 20 tons
  2 23 is $375 plus $25 for each ton over 20 tons up to the maximum
  2 24 of 40 tons.
  2 25    Current law provides that a truck, trailer, or tractor, or
  2 26 combination thereof, carrying a load of raw farm products,
  2 27 soil fertilizers, including ground limestone, raw dairy
  2 28 products or livestock, live poultry, and eggs, may be operated
  2 29 with a gross weight of 25 percent in excess of the gross
  2 30 weight for which it is registered.  This bill caps the gross
  2 31 weight allowance at 80,000 pounds.
