1 1 Section 1. Section 321.354, subsection 2, Code 1997, is
1 2 amended to read as follows:
1 3 2. Upon the main traveled part of a highway other than a
1 4 paved highway when it is practical to stop, park, or leave the
1 5 vehicle off that part of the highway. However, a clear and
1 6 unobstructed width of that part of the highway opposite the
1 7 standing vehicle shall be left to allow for the free passage
1 8 of other vehicles. This subsection shall not apply to a
1 9 person who parks a grain truck upon the main traveled part of
1 10 an unpaved highway for a period of five minutes or less as
1 11 required due to ground conditions which make parking off the
1 12 traveled part unsafe or make it likely the grain truck would
1 13 become stuck if parked off the traveled part.
1 14 EXPLANATION
1 15 This bill provides that a person who parks a grain truck
1 16 for a period of five minutes or less on the traveled part of
1 17 an unpaved road is not subject to a penalty for doing so if
1 18 parking the truck on the road was due to ground conditions
1 19 which make it unsafe to park the truck off the road or which
1 20 would cause the truck to become stuck if it were parked off
1 21 the road.
