  1  1    Section 1.  Section 357A.11, subsection 11, Code 1997, is
  1  2 amended to read as follows:
  1  3    11.  Have authority to execute an agreement with a
  1  4 governmental entity, including a county, city, sanitary sewer
  1  5 district, or another district, for purposes of repairing,
  1  6 improving, equipping, managing, or administering the
  1  7 governmental entity's works, facilities, or waterways which
  1  8 are useful for the collection, disposal, or treatment of
  1  9 wastewater or sewage and which are located within the
  1 10 jurisdiction of the governmental entity or the district.  The
  1 11 board may do what is necessary to carry out the agreement,
  1 12 including but not limited to any of the following:
  1 13    a.  Acquiring by gift, lease, purchase, or grant any
  1 14 interest in real or personal property.
  1 15    b.  Constructing, operating, maintaining, repairing,
  1 16 improving, or equipping any works or facilities.
  1 17    c.  Financing all or part of the cost of acquiring,
  1 18 constructing, maintaining, repairing, improving, or equipping
  1 19 any works or facilities or refinancing all or part of the
  1 20 cost.  The financing or refinancing shall be accomplished in
  1 21 accordance with the terms and procedures set forth in the
  1 22 applicable provisions of sections 384.24; 384.83 through
  1 23 384.88, 384.92, and 384.93.  References in those sections to a
  1 24 city shall be applicable to a district and references in those
  1 25 sections to a governing body or a city council shall be
  1 26 applicable to the district's board.  
  1 27                           EXPLANATION
  1 28    This bill amends Code section 357A.11 which provides for
  1 29 the powers and duties of a board of directors for a rural
  1 30 water district.  The bill amends a provision which authorizes
  1 31 a board to execute an agreement with a governmental entity for
  1 32 purposes of managing or administering the governmental
  1 33 entity's wastewater or sewage disposal and treatment
  1 34 facilities.  This bill provides that the agreement may provide
  1 35 for acquiring, constructing, maintaining, repairing,
  2  1 improving, or equipping facilities located within the
  2  2 jurisdiction of the governmental entity or the district.  The
  2  3 bill provides that this may include financing the associated
  2  4 costs by the issuance of revenue obligations according to
  2  5 procedures applicable to cities.
