  1  1    Section 1.  Section 261.2, Code 1997, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  15.  Deny, revoke, or suspend, at the
  1  4 discretion of the commission, any license authorized by the
  1  5 laws of this state, as defined in section 252J.1, to any
  1  6 person who has defaulted on an obligation owed to or collected
  1  7 by the commission, in accordance with section 421.17,
  1  8 subsection 34, paragraph "e".  The commission shall develop,
  1  9 in cooperation with state licensing authorities, as defined in
  1 10 section 252J.1, policies and procedures governing the denial,
  1 11 revocation, or suspension of the license of a person who has
  1 12 defaulted on an obligation owed to or collected by the
  1 13 commission.  The policies and procedures shall include due
  1 14 process safeguards.
  1 15    Sec. 2.  Section 261.19, Code 1997, is amended by striking
  1 16 the section and inserting in lieu thereof the following:
  1 17    261.19  OSTEOPATHIC PHYSICIAN RECRUITMENT PROGRAM.
  1 18    1.  A physician recruitment program is established, to be
  1 19 administered by the college student aid commission, for the
  1 20 university of osteopathic medicine and health sciences.  The
  1 21 purpose of the program is to provide incentives for physicians
  1 22 to locate and practice in this state.  The program shall
  1 23 consist of a forgivable loan program and a tuition scholarship
  1 24 program for students who are residents of this state and who
  1 25 are enrolled at the university and, for physicians who agree
  1 26 to practice in this state, a loan repayment program.  The
  1 27 commission shall regularly adjust the physician service
  1 28 requirement under each aspect of the program to provide, to
  1 29 the extent possible, an equal financial benefit for each
  1 30 period of service required.  From funds appropriated for
  1 31 purposes of the program by the general assembly, the
  1 32 commission shall pay a fee to the university for the
  1 33 administration of subsections 3 and 4.  Fifty percent of the
  1 34 fee shall be paid by the commission to the university in
  1 35 quarterly payments and the remainder of the fee shall be
  2  1 variable and shall be paid by the commission to the university
  2  2 based upon the number of physicians recruited under
  2  3 subsections 3 and 4, but shall not exceed fifty percent of the
  2  4 fee.
  2  5    2.  a.  A student enrolled at the university of osteopathic
  2  6 medicine and health sciences shall be eligible for loan
  2  7 forgiveness under the forgivable loan program if the student
  2  8 is a resident of this state and if the student does the
  2  9 following:
  2 10    (1)  Graduates from the university of osteopathic medicine
  2 11 and health sciences.
  2 12    (2)  Successfully completes a residency program.
  2 13    (3)  Practices in this state.
  2 14    (4)  Receives a loan from moneys appropriated to the
  2 15 commission for this program.
  2 16    b.  A student who receives a forgivable loan shall agree to
  2 17 practice in this state for a period of time to be determined
  2 18 by the commission at the time the loan is awarded.  If the
  2 19 student completes the time period established by the
  2 20 commission and agreed to by the student, the loan amount shall
  2 21 be forgiven.  Forgivable loans to eligible students shall not
  2 22 become due and interest on the loan shall not accrue until
  2 23 after the student completes a residency program, but fails to
  2 24 complete the required time period of practice in this state,
  2 25 or fails to satisfactorily continue in the university's
  2 26 program of medical education.
  2 27    3.  A student enrolled at the university of osteopathic
  2 28 medicine and health sciences who is a resident of this state
  2 29 shall be eligible for a tuition scholarship for both the third
  2 30 and fourth years of the student's study at the university.
  2 31 The scholarship shall be for an amount not to exceed the
  2 32 annual tuition at the university.  A student who receives a
  2 33 tuition scholarship shall not be eligible for the loan
  2 34 repayment program provided for by this section.  A student who
  2 35 receives a tuition scholarship shall agree to practice in an
  3  1 eligible rural community in this state for a period of time to
  3  2 be determined by the commission at the time the scholarship is
  3  3 awarded.  The student shall repay the scholarship to the
  3  4 commission if the student fails to practice in an eligible
  3  5 rural community in this state for the required period of time.
  3  6    4.  A physician who graduated from the university of
  3  7 osteopathic medicine and health sciences and received a loan
  3  8 from moneys appropriated to the commission for purposes of
  3  9 this section shall be eligible for the physician loan
  3 10 repayment program if the physician agrees to practice in an
  3 11 eligible rural community in this state.  The university of
  3 12 osteopathic medicine and health sciences shall recruit and
  3 13 place physicians in rural communities which have agreed to
  3 14 provide additional funds for the physician's loan repayment.
  3 15 The contract for the loan repayment shall stipulate the time
  3 16 period the physician shall practice in an eligible rural
  3 17 community in this state, and that the physician repay any
  3 18 funds paid on the physician's loan by the commission if the
  3 19 physician fails to practice in an eligible rural community in
  3 20 this state for the required period of time.
  3 21    Sec. 3.  REPEAL.  Sections 261.18 and 261.19A, Code 1997,
  3 22 are repealed.  
  3 23                           EXPLANATION
  3 24    This bill permits the college student aid commission to
  3 25 deny, revoke, or suspend any license authorized by the laws of
  3 26 this state to any person who has defaulted on an obligation
  3 27 owed to or collected by the commission.  The bill also
  3 28 replaces the osteopathic grant program, the osteopathic
  3 29 subvention program, and the osteopathic forgivable loan
  3 30 program with a program titled the osteopathic physician
  3 31 recruitment program.
  3 32    The osteopathic physician recruitment program provides for
  3 33 a forgivable loan program, a tuition scholarship program, and
  3 34 a physician loan repayment program for residents of Iowa
  3 35 enrolled at the university of osteopathic medicine and health
  4  1 sciences.
  4  2    As provided in the current osteopathic forgivable loan
  4  3 program, the bill provides that a student enrolled at the
  4  4 university of osteopathic medicine is eligible for loan
  4  5 forgiveness if the student is a resident of the state of Iowa
  4  6 and if the student graduates from the university, successfully
  4  7 completes a residency program, practices in this state, and
  4  8 receives a loan from the commission under this program.
  4  9    Loans are not forgiven if a student does not finish the
  4 10 medical program or fails to complete the agreed upon time
  4 11 period of practice in the state.
  4 12    Under the tuition scholarship program, a student enrolled
  4 13 at the university who is a resident of Iowa is eligible for a
  4 14 tuition scholarship for both the third and fourth years of the
  4 15 student's study at the university.  A student who receives a
  4 16 tuition scholarship is not eligible for the loan repayment
  4 17 program.  The student who receives a tuition scholarship must
  4 18 agree to practice in this state for a period of time to be
  4 19 determined by the commission at the time the scholarship is
  4 20 awarded.
  4 21    Under the physician loan repayment program, physicians who
  4 22 graduated from the university of osteopathic medicine and
  4 23 health sciences, who received a loan from moneys appropriated
  4 24 to the commission for purposes of the osteopathic physician
  4 25 recruitment program, and who agree to practice in a rural
  4 26 community in the state are eligible for loan repayment under
  4 27 the program.  The university is directed to recruit and place
  4 28 physicians in rural communities which have agreed to provide
  4 29 additional funds for the physician's loan repayment.
  4 30    Students who received a tuition scholarship, or physicians
  4 31 for whom loan repayments were made, and who fail to complete
  4 32 the agreed upon time period of practice in a rural community
  4 33 in the state, are required under the bill to repay the
  4 34 commission for moneys received under the tuition scholarship
  4 35 program or physician loan repayment program.
  5  1    Under the bill, the commission pays a fee to the university
  5  2 for the university's administration of the tuition scholarship
  5  3 program and the physician loan repayment program.
