PAG LIN 1 1 Section 1. Section 99D.11, subsection 7, Code 1997, is 1 2 amended to read as follows: 1 3 7. A person under the age of twenty-one years shall not 1 4 make or attempt to make a pari-mutuel wager. A person who 1 5 violates this subsection commits a scheduled violation under 1 6 section 805.8, subsection 13. 1 7 Sec. 2. Section 99E.18, Code 1997, is amended by adding 1 8 the following new subsection: 1 9 NEW SUBSECTION. 5. A person under the age of twenty-one 1 10 years shall not purchase, or attempt to purchase, a ticket or 1 11 share. A person who violates this subsection commits a 1 12 scheduled violation under section 805.8, subsection 13. 1 13 Sec. 3. NEW SECTION. 99F.4C MORATORIUM FOR ISSUANCE OF 1 14 LICENSES FOR GAMBLING GAMES ON EXCURSION GAMBLING BOATS. 1 15 1. Except as to licenses which may be issued to applicants 1 16 with pending applications prior to July 1, 1997, the total 1 17 number of licenses issued to conduct gambling games on 1 18 excursion gambling boats pursuant to this chapter shall not 1 19 exceed nine until December 1, 2002. Not later than July 1, 1 20 1997, the commission may issue not more than two new licenses 1 21 to conduct gambling games on excursion gambling boats to 1 22 applicants with applications pending before that date, but the 1 23 total number of licenses issued to conduct gambling games on 1 24 excursion gambling boats shall not exceed eleven as of July 1, 1 25 1997. 1 26 2. Notwithstanding subsection 1, the following actions may 1 27 be taken during the moratorium from July 1, 1997, until 1 28 December 1, 2002, with the approval of the commission: 1 29 a. A licensed excursion gambling boat may move to a new 1 30 location within the same county. 1 31 b. A licensed excursion gambling boat and its facilities 1 32 may be sold and a new license may be issued for operation in 1 33 the same county. 1 34 c. If a license to conduct gambling games on an excursion 1 35 gambling boat is surrendered, not renewed, or revoked, a new 2 1 license may be issued for operation in the same county. 2 2 3. This section does not affect the validity of a license 2 3 issued by the commission pursuant to chapter 99F before the 2 4 effective date of this Act or the authority of the commission 2 5 to suspend, revoke, or renew a license issued before the 2 6 effective date of this Act pursuant to chapter 99F. 2 7 Sec. 4. Section 99F.9, subsection 5, Code 1997, is amended 2 8 to read as follows: 2 9 5. A person under the age of twenty-one years shall not 2 10 attempt to make or make a wager on an excursion gambling boat 2 11 or in a racetrack enclosure and shall not be allowed in the 2 12 area of the excursion gambling boat or racetrack enclosure 2 13 where gambling is being conducted. A person who violates this 2 14 subsection with respect to a wager commits a scheduled 2 15 violation under section 805.8, subsection 13. However, a 2 16 person eighteen years of age or older may be employed to work 2 17 in a gambling area. 2 18 Sec. 5. Section 805.8, Code 1997, is amended by adding the 2 19 following new subsection: 2 20 NEW SUBSECTION. 13. GAMBLING VIOLATIONS. For violations 2 21 of legal age for gambling or pari-mutuel wagering under 2 22 section 99D.11, subsection 7, section 99E.18, subsection 5, or 2 23 section 99F.9, subsection 5, the scheduled fine is one hundred 2 24 dollars. Failure to pay the fine by a person under the age of 2 25 eighteen shall not result in the person being detained in a 2 26 secure facility. 2 27 EXPLANATION 2 28 This bill proposes three changes to the gambling laws in 2 29 this state. The bill imposes a $100 scheduled fine on a 2 30 person under 21 years of age who attempts to gamble or gambles 2 31 on an excursion gambling boat or at a racetrack enclosure, who 2 32 attempts to purchase or purchases a lottery ticket or share, 2 33 or who attempts to place or places a pari-mutuel wager. 2 34 The bill also imposes a moratorium on the issuing of 2 35 licenses to conduct gambling games on excursion gambling boats 3 1 until December 1, 2002, and freezes the number of excursion 3 2 gambling boat licenses at nine. However, the total number of 3 3 excursion gambling boat licenses authorized may be increased 3 4 to 11 if two pending applications are approved before July 1, 3 5 1997. An excursion gambling boat may be sold and a new 3 6 license may be issued in the same county during the 3 7 moratorium. The operation of an excursion gambling boat may 3 8 be relocated within a county with the commission's approval 3 9 and the commission may reissue for the same county a license 3 10 that is surrendered, not renewed, or revoked. 3 11 LSB 1510XL 77 3 12 tj/jj/8.1
