PAG LIN 1 1 Section 1. TEMPORARY ASSISTANCE FOR NEEDY FAMILIES BLOCK 1 2 GRANT. There is appropriated from the fund created in section 1 3 8.41 to the department of human services for the fiscal year 1 4 beginning July 1, 1996, and ending June 30, 1997, from moneys 1 5 received under the federal temporary assistance for needy 1 6 families block grant pursuant to the federal Personal 1 7 Responsibility and Work Opportunity Reconciliation Act of 1 8 1996, Pub. L. No. 104-193, which were appropriated for the 1 9 federal fiscal year beginning October 1, 1996, and ending 1 10 September 30, 1997, the following amounts to be used for the 1 11 purposes designated: 1 12 Moneys appropriated in this section shall be used in 1 13 accordance with the federal law making the funds available, 1 14 applicable Iowa law, and administrative rules adopted to 1 15 implement the federal and Iowa law. If actual federal 1 16 revenues credited to the fund created in section 8.41 through 1 17 June 30, 1997, are less than the amounts appropriated in this 1 18 section, the amounts appropriated shall be reduced 1 19 proportionately and the department may reduce expenditures as 1 20 deemed necessary by the department to meet the reduced funding 1 21 level: 1 22 1. For assistance under the family investment program 1 23 under chapter 239 and in accordance with 1996 Iowa Acts, 1 24 chapter 1213, section 1: 1 25 .................................................. $ 71,040,801 1 26 For the fiscal year beginning July 1, 1996, the department 1 27 shall continue the practice of depositing child support 1 28 assigned to the state under the family investment program into 1 29 the family investment program appropriation. However, if the 1 30 federal government reduces the amount of federally 1 31 reimbursable administrative costs for child support payable to 1 32 the state, then not more than an amount equivalent to the 1 33 reduction may be deposited into the appropriation for that 1 34 fiscal year to the department for child support recovery. 1 35 Moneys deposited in accordance with this paragraph are 2 1 appropriated for the purposes of the appropriation to which 2 2 the moneys are deposited. 2 3 2. Of the funds appropriated in this section,$2,496,2863 13 $3,220,487 shall be used for protective child day care 3 14 assistance. 3 15 Sec. 4. 1996 Iowa Acts, chapter 1213, section 10, 3 16 unnumbered paragraph 2, is amended to read as follows: 3 17 For child and family services: 3 18 .................................................. $85,460,6073 19 95,907,604 3 20 Sec. 5. 1996 Iowa Acts, chapter 1213, section 10, 3 21 subsection 9, is amended to read as follows: 3 22 9. Notwithstanding section 234.35, subsection 1, for the 3 23 fiscal year beginning July 1, 1996, state funding for shelter 3 24 care paid pursuant to section 234.35, subsection 1, paragraph 3 25 "h", shall be limited to $3,223,7325,914,676. The department 3 26 shall develop a formula in consultation with the shelter care 3 27 committee created by the department to allocate shelter care 3 28 funds to the department's regions. The formula shall be based 3 29 on the region's proportion of the state population of children 3 30 and historical usage. FTEs 401.00 4 13 Sec. 8. TRANSFER AUTHORITY. Subject to the provisions of 4 14 section 8.39, for the fiscal year beginning July 1, 1996, if 4 15 necessary to meet federal maintenance of effort requirements, 4 16 the department of human services may transfer between any of 4 17 the appropriations made to the department for the following 4 18 purposes in adjusting for funding that the state would have 4 19 previously been eligible to receive as federal matching funds 4 20 under Titles IV-A and IV-F of the federal Social Security Act, 4 21 provided that the combined amount of state and federal 4 22 temporary assistance for needy families block grant funding 4 23 for each appropriation remains the same before and after the 4 24 transfer: 4 25 1. For the family investment program made in this Act and 4 26 in 1996 Iowa Acts, chapter 1213. 4 27 2. For child day care assistance made in this Act and in 4 28 1996 Iowa Acts, chapters 1210 and 1213. 4 29 3. For child and family services made in this Act and in 4 30 1996 Iowa Acts, chapter 1213. 4 31 4. For field operations made in this Act and in 1996 Iowa 4 32 Acts, chapters 1210 and 1213. 4 33 5. For general administration made in this Act and in 1996 4 34 Iowa Acts, chapters 1210 and 1213. 4 35 Sec. 9. EFFECTIVE DATE. This Act, being deemed of 5 1 immediate importance, takes effect upon enactment. 5 2 EXPLANATION 5 3 This bill appropriates federal funds received for the state 5 4 fiscal year beginning July 1, 1996, under the federal 5 5 temporary assistance for needy families block grant to the 5 6 department of human services. The bill amends state general 5 7 fund appropriations and allocations to the department for that 5 8 fiscal year. In addition, the department is provided 5 9 appropriation transfer authority among certain appropriations 5 10 as necessary to meet federal maintenance of effort 5 11 requirements and other conditions. The bill provides that the 5 12 appropriations made in the bill do not revert to the fund from 5 13 which appropriated at the close of the fiscal year but remain 5 14 available for the purpose designated in the succeeding fiscal 5 15 year. 5 16 The bill takes effect upon enactment. 5 17 LSB 1720JA 77 5 18 jp/sc/14.2
