PAG LIN 1 1 Section 1. Section 731.5, Code 1997, is amended to read as 1 2 follows: 1 3 731.5 DEDUCTING DUES FROM PAY UNLAWFUL. 1 4 It shall be unlawful for any person, firm, association, 1 5 labor organization, or corporation to deduct labor 1 6 organization dues, charges, fees, contributions, fines, or 1 7 assessments from an employee's earnings, wages, or 1 8 compensation, unless the employer has first been presented 1 9 with an individual written order therefor signed by the 1 10 employee, which written order shall terminate one year from 1 11 the date the written order is signed and shall be terminable 1 12 at any time by the employee giving at least thirty days' 1 13 written notice of such termination to the employer. 1 14 Sec. 2. NEW SECTION. 731.5A DUES FOR POLITICAL CAUSES – 1 15 REQUIREMENTS. 1 16 It shall be unlawful for a labor organization to accept 1 17 payment of any labor organization dues or fees for political 1 18 causes of the labor organization unless the employee has 1 19 agreed to pay such dues or fees in a signed written agreement 1 20 which agreement shall terminate upon thirty days' written 1 21 notice of such termination by the employee to the labor 1 22 organization or one year from the date the agreement is 1 23 signed, whichever occurs first. The labor organization shall 1 24 permit an employee to separately authorize the payment of dues 1 25 or fees solely related to the representation of the employee, 1 26 including fees for collective bargaining, contract 1 27 administration, and grievance adjustment, and that are not 1 28 used for the political causes of the organization. 1 29 EXPLANATION 1 30 This bill provides that an individual written order signed 1 31 by an employee authorizing a deduction from the employee's 1 32 wages for union dues shall terminate one year from the date 1 33 the authorization is signed. The bill does not prohibit the 1 34 employee from reauthorizing the deduction after the order is 1 35 terminated. A violation of the provisions of this section 2 1 constitutes a serious misdemeanor pursuant to section 731.6. 2 2 The bill also provides in new Code section 731.5A that it 2 3 is unlawful for a labor organization to require an employee to 2 4 pay that portion of union dues used for political causes of 2 5 the union without a written agreement authorizing such 2 6 payment. The bill allows for termination of the agreement 2 7 upon 30 days' notice or automatically after one year, 2 8 whichever occurs first. The bill provides that the employee 2 9 shall be permitted to pay union dues used for the 2 10 representation of the employee and that are not used for 2 11 political causes of the union. A violation of the provisions 2 12 of this new Code section also constitutes a serious 2 13 misdemeanor pursuant to section 731.6. 2 14 LSB 1254YC 77 2 15 ec/cf/24.1
