PAG LIN 1 1 Section 1. The following amendment to the Constitution of 1 2 the State of Iowa is proposed: 1 3 Section 4 of Article III of the Constitution of the State 1 4 of Iowa, as amended by the Amendment of 1880 and the Amendment 1 5 of 1926, is repealed beginning with terms of office filled at 1 6 the general election in the year 2002 and the following 1 7 adopted in lieu thereof: 1 8 QUALIFICATIONS. Sec. 4. A person shall not be a member of 1 9 the House of Representatives unless the person shall have 1 10 attained the age of twenty-one years, be a citizen of the 1 11 United States, and shall have been an inhabitant of this State 1 12 one year next preceding the person's election, and at the time 1 13 of the person's election shall have had an actual residence of 1 14 sixty days in the district the person may have been chosen to 1 15 represent, and shall continue to reside, and shall maintain a 1 16 permanent residence, in the district for the length of the 1 17 term to which the representative was elected. 1 18 Sec. 2. The foregoing amendment to the Constitution of the 1 19 State of Iowa is referred to the General Assembly to be chosen 1 20 at the next general election for members of the General 1 21 Assembly and the Secretary of State is directed to cause the 1 22 same to be published for three consecutive months previous to 1 23 the date of that election as provided by law. 1 24 EXPLANATION 1 25 This joint resolution proposes an amendment to the 1 26 Constitution of the State of Iowa to provide that a member of 1 27 the Iowa senate or Iowa house of representatives shall reside, 1 28 and maintain a permanent residence, in the district from which 1 29 the member was elected. The residency and citizenship 1 30 qualifications established by the Constitution for members of 1 31 the Iowa House of Representatives also apply to members of the 1 32 Iowa Senate per Article III, section 5 of the Constitution. 1 33 The amendment applies beginning with terms of office filled at 1 34 the 2002 general election. 1 35 The resolution, if adopted, would be referred to the next 2 1 general assembly before being submitted to the electorate for 2 2 ratification. 2 3 LSB 2285YH 77 2 4 sc/jw/5
