PAG LIN 1 1 HOUSE FILE 2443 1 2 1 3 AN ACT 1 4 RELATING TO STATE WORKERS' COMPENSATION COVERAGE FOR 1 5 STUDENTS AT A COMMUNITY COLLEGE PARTICIPATING IN 1 6 SCHOOL-TO-WORK PROGRAMS. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 85.61, subsection 2, unnumbered 1 11 paragraph 2, Code Supplement 1997, is amended to read as 1 12 follows: 1 13 "Employer" also includes and applies to an eligible 1 14 postsecondary institution as defined in section 261C.3, 1 15 subsection 1, a school corporation, or an accredited nonpublic 1 16 school if a student enrolled in the eligible postsecondary 1 17 institution, school corporation, or accredited nonpublic 1 18 school is providing unpaid services under a school-to-work 1 19 program that includes, but is not limited to, the components 1 20 provided for in section 258.10, subsection 2, paragraphs "a" 1 21 through "f". However, ifsucha student participating in a 1 22 school-to-work program is participating in open enrollment 1 23 under section 282.18, "employer" means the receiving district. 1 24 "Employer" also includes and applies to a community college as 1 25 defined in section 260C.2, if a student enrolled in the 1 26 community college is providing unpaid services under a school- 1 27 to-work program that includes, but is not limited to, the 1 28 components provided for in section 258.10, subsection 2, 1 29 paragraphs "a" through "f", and that is offered by the 1 30 community college pursuant to a contractual agreement with a 1 31 school corporation or accredited nonpublic school to provide 1 32 the program. If a student participating in a school-to-work 1 33 program that includes, but is not limited to, the components 1 34 provided for in section 258.10, subsection 2, paragraphs "a" 1 35 through "f", is paid for services provided under the program, 2 1 "employer" means any entity otherwise defined as an employer 2 2 under this subsection which pays the student for providing 2 3 services under the program. 2 4 Sec. 2. Section 85.61, subsection 11, unnumbered paragraph 2 5 5, Code Supplement 1997, is amended to read as follows: 2 6 "Worker" or "employee" includes a student enrolled in a 2 7 public school corporation or accredited nonpublic school who 2 8 is participating in a school-to-work program that includes, 2 9 but is not limited to, the components provided for in section 2 10 258.10, subsection 2, paragraphs "a" through "f". "Worker" or 2 11 "employee" also includes a student enrolled in a community 2 12 college as defined in section 260C.2, who is participating in 2 13 a school-to-work program that includes, but is not limited to, 2 14 the components provided for in section 258.10, subsection 2, 2 15 paragraphs "a" through "f" and that is offered by the 2 16 community college pursuant to a contractual agreement with a 2 17 school corporation or accredited nonpublic school to provide 2 18 the program. 2 19 2 20 2 21 2 22 RON J.
