PAG LIN 1 1 Section 1. Section 161A.73, subsection 2, paragraph b, 1 2 Code 1997, is amended to read as follows: 1 3 b. The allocation of cost-share moneys as financial 1 4 incentives to encourage summer construction of permanent soil 1 5 and water conservation practices. The practices must be 1 6 constructed on or after June 1 but not later thanAugust1 7 September 15. The commissioners may also provide for the 1 8 payment of moneys on a prorated basis to compensate persons 1 9 for the production loss on an area disturbed by construction, 1 10 according to rules which shall be adopted by the division. 1 11 The commissioners shall not allocate cost-share moneys to 1 12 support summer construction during a fiscal year in which 1 13 applications for cost-share moneys required to establish 1 14 permanent soil and water conservation practices, other than 1 15 established by summer construction, equal the total amount 1 16 available to support the nonsummer construction practices. 1 17 The financial incentives shall not exceed sixty percent of the 1 18 estimated cost of establishing the practice as determined by 1 19 the commissioners, or sixty percent of the actual cost of 1 20 establishing the practice, whichever is less. 1 21 EXPLANATION 1 22 This bill amends a provision in Code chapter 161A which 1 23 provides for the administration of soil and water conservation 1 24 practices by district commissioners. Code section 161A.73 1 25 provides that the commissioners of a district may establish 1 26 voluntary financial incentive programs that provide for the 1 27 allocation of cost-share moneys to encourage summer 1 28 construction of permanent soil and water conservation 1 29 practices. The Code section provides that the practices must 1 30 be constructed on or after June 1, but not later than August 1 31 15.
