  1  1    Section 1.  Section 123.53, subsection 4, Code 1997, is
  1  2 amended to read as follows:
  1  3    4.  The treasurer of state, after making the transfer
  1  4 transfers provided for in subsection subsections 3 and 6,
  1  5 shall transfer to the division from the beer and liquor
  1  6 control fund and before any other transfer to the general
  1  7 fund, an amount sufficient to pay the costs incurred by the
  1  8 division for collecting and properly disposing of the liquor
  1  9 containers.
  1 10    Sec. 2.  Section 123.53, Code 1997, is amended by adding
  1 11 the following new subsection:
  1 12    NEW SUBSECTION.  6.  The treasurer of state shall
  1 13 semiannually distribute a sum of money equal to at least ten
  1 14 percent of the gross sales made by the division but not less
  1 15 than six million four hundred thousand dollars to the cities
  1 16 of the state.  The amount shall be distributed to the cities
  1 17 of the state in proportion to the population of each
  1 18 incorporated city bears to the total population of all
  1 19 incorporated cities of the state as computed by the latest
  1 20 federal census.  A city may have one special federal census
  1 21 taken each decade, and the population figure thus obtained
  1 22 shall be used in apportioning amounts under this subsection
  1 23 beginning in the calendar year following the year in which the
  1 24 special census is certified by the secretary of state.  The
  1 25 apportionment shall be made semiannually as of July 1 and
  1 26 January 1 of each year.  Warrants for the apportionment shall
  1 27 be issued by the director of revenue and finance upon
  1 28 certification of the treasurer of state and mailed to the city
  1 29 clerk of each incorporated city of the state and shall be made
  1 30 payable to the incorporated city and are subject to
  1 31 expenditure under the direction of the county board of health
  1 32 which shall distribute the money in accordance with the needs
  1 33 identified through a substance abuse needs assessment for the
  1 34 treatment, rehabilitation, and education for persons who are
  1 35 substance abusers or at risk for substance abuse in this
  2  1 state.  
  2  2                           EXPLANATION 
  2  3    This bill provides for the allocation semiannually of a sum
  2  4 equal to 10 percent of the gross sales made by the alcoholic
  2  5 beverages division, but not less than $6.4 million, to the
  2  6 cities of the state.  The moneys shall be allocated in
  2  7 proportion to the population that each city bears to the total
  2  8 population of all cities.  The moneys shall be used under the
  2  9 direction of the county board of health for the treatment,
  2 10 rehabilitation, and education of persons who are substance
  2 11 abusers or at risk for substance abuse in this state.
