  1  1    Section 1.  Section 715A.2A, subsection 3, paragraphs a, b,
  1  2 and c, Code 1997, are amended to read as follows:
  1  3    a.  For a first violation, not less than two hundred and
  1  4 fifty five thousand dollars and not more than two ten thousand
  1  5 dollars for each unauthorized alien hired or employed.
  1  6    b.  For a second violation, not less than two ten thousand
  1  7 dollars and not more than five twenty-five thousand dollars
  1  8 for each unauthorized alien hired or employed.
  1  9    c.  For a third or subsequent violation, not less than
  1 10 three twenty-five thousand dollars and not more than ten fifty
  1 11 thousand dollars for each unauthorized alien hired or
  1 12 employed.  
  1 13                           EXPLANATION
  1 14    This bill increases the civil penalties applicable to the
  1 15 hiring or employment of unauthorized aliens.  The penalty
  1 16 applicable to employers who hire or employ an alien who is not
  1 17 authorized to be employed in the United States is raised to a
  1 18 minimum of $5,000 and a maximum of $10,000 for a first
  1 19 offense, a minimum of $10,000 and a maximum of $25,000 for a
  1 20 second offense, and a minimum of $25,000 and a maximum of
  1 21 $50,000 for a third or subsequent offense.  The penalty is a
  1 22 civil fine which is levied through an equitable civil
  1 23 proceeding.  Penalties collected are to be paid to the
  1 24 treasurer of state for deposit in the general fund of the
  1 25 state.
