1 4 RELATING TO PERMITTING THE DISPLAY OF NEW MOTOR TRUCKS BY
1 5 NONRESIDENT MOTOR VEHICLE DEALERS AT QUALIFIED EVENTS IN
1 6 THIS STATE, ESTABLISHING A FEE, AND PROVIDING AN EFFECTIVE
1 7 DATE.

1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 11 Section 1. Section 322.5, Code 1997, is amended by adding
1 12 the following new subsection:
1 13 NEW SUBSECTION. 4. A nonresident motor vehicle dealer,
1 14 who is authorized by a written contract with a manufacturer or
1 15 distributor of new motor trucks to sell at retail such new
1 16 motor trucks, may display motor trucks within this state at
1 17 qualified events approved by the department. The dealer must
1 18 obtain a temporary permit from the department. An application
1 19 for a temporary permit shall be made upon a form provided by
1 20 the department and shall be accompanied by a ten dollar permit
1 21 fee. Permits shall be issued for a period not to exceed
1 22 fourteen days. The department shall issue a temporary permit
1 23 under this subsection only if the qualified event for which
1 24 the permit is issued meets all of the following conditions:
1 25 a. The sale of motor vehicles is not allowed during the
1 26 qualified event.
1 27 b. The qualified event is conducted in a controlled area
1 28 and is not open to the public generally.
1 29 c. The qualified event generally promotes the motor truck
1 30 industry.
1 31 d. The qualified event is conducted within the area of
1 32 responsibility that is specified in the motor vehicle dealer's
1 33 contract with the manufacturer or distributor.
1 34 A temporary permit shall not be issued under this
1 35 subsection unless the state in which the nonresident motor
2 1 vehicle dealer is licensed extends by reciprocity similar
2 2 privileges to a motor vehicle dealer licensed by this state.
2 3 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
2 4 immediate importance, takes effect upon enactment.
