  1  1    Section 1.  Section 314.25, Code 1997, is amended to read
  1  2 as follows:
  1  3    314.25  GREEN SPACE PROVIDED.
  1  4    The department shall use the property owned by it in the
  1  5 city of Council Bluffs which is bounded by Broadway, Seventh
  1  6 street, Kanesville boulevard, and Sixth street, the department
  1  7 and described in this section exclusively for green space,
  1  8 and, if sold by the department, the department shall sell the
  1  9 property with the restricted covenant that the property shall
  1 10 be used exclusively for green space or else revert to the
  1 11 department.  This section applies to the following property:
  1 12    1.  Property located in the city of Council Bluffs which is
  1 13 bounded by Broadway, Seventh street, Kanesville boulevard, and
  1 14 Sixth street.
  1 15    2.  Property commonly known as the Eddyville dunes and
  1 16 wetland complex.  This property includes property purchased or
  1 17 condemned by the department for right-of-way acquisition,
  1 18 mitigation purposes, or in connection with right-of-way
  1 19 acquisition for the 1990 alignment of the proposed Eddyville
  1 20 bypass.  
  1 21                           EXPLANATION
  1 22    This bill requires the department of transportation to use
  1 23 property owned by it and commonly known as the Eddyville dunes
  1 24 and wetland complex exclusively for green space.  This
  1 25 property includes property purchased or condemned by the
  1 26 department for the 1990 alignment of the proposed Eddyville
  1 27 bypass.  If the land is sold, the department shall sell the
  1 28 property with the restricted covenant that the property shall
  1 29 be used exclusively for green space or else revert to the
  1 30 department.
