  1  4 RELATING TO THE STATUTORY ELEMENTS OF CERTAIN FORMS OF
  1  5    ASSAULT.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 708.2, subsection 2, Code 1997, is
  1 10 amended to read as follows:
  1 11    2.  A person who commits an assault, as defined in section
  1 12 708.1, without the intent to inflict a serious injury upon
  1 13 another, and who causes bodily injury or disabling mental
  1 14 illness, is guilty of a serious misdemeanor.
  1 15    Sec. 2.  Section 708.3A, subsection 3, Code 1997, is
  1 16 amended to read as follows:
  1 17    3.  A person who commits an assault, as defined in section
  1 18 708.1, against a peace officer, health care provider, or fire
  1 19 fighter, whether paid or volunteer, who knows that the person
  1 20 against whom the assault is committed is a peace officer,
  1 21 health care provider, or fire fighter, and who causes bodily
  1 22 injury or disabling mental illness, is guilty of an aggravated
  1 23 misdemeanor.
