PAG LIN 1 1 HOUSE FILE 2290 1 2 1 3 AN ACT 1 4 RELATING TO THE REGULATION OF THE DEER POPULATION AND TO 1 5 THE CIVIL DAMAGES AND PENALTIES FOR THE ILLEGAL TAKING 1 6 OF ANTLERED DEER. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 481A.93, Code 1997, is amended to read 1 11 as follows: 1 12 481A.93 HUNTING BY ARTIFICIAL LIGHT. 1 13 1. A person shall not throw or cast the rays of a 1 14 spotlight, headlight, or other artificial light on a highway, 1 15 or in a field, woodland, or forest for the purpose of 1 16 spotting, locating, or taking or attempting to take or hunt a 1 17 bird or animal, except raccoons or other fur-bearing animals 1 18 when treed with the aid of dogs, while having in possession or 1 19 control, either singly or as one of a group of persons, any 1 20 firearm, bow, or other implement or device whereby a bird or 1 21 animal could be killed or taken. 1 22 2. This section does not apply to deer being taken by or 1 23 under the control of a local governmental body within its 1 24 corporate limits pursuant to an approved special deer 1 25 population control plan. 1 26 Sec. 2. Section 481A.130, subsection 1, paragraph g, Code 1 27 1997, is amended by striking the paragraph and inserting in 1 28 lieu thereof the following: 1 29 g. For each antlered deer during September, October, 1 30 November, or December before the regular gun season, two 1 31 thousand dollars and eighty hours of community service or, in 1 32 lieu of the community service, a total of four thousand 1 33 dollars. 1 34 Sec. 3. Section 481A.130, subsection 1, Code l997, is 1 35 amended by adding the following new paragraph: 2 1 NEW PARAGRAPH. h. For each deer, except as provided in 2 2 paragraph "g", one thousand five hundred dollars. 2 3 Sec. 4. Section 481C.2, Code Supplement 1997, is amended 2 4 to read as follows: 2 5 481C.2 DUTIES. 2 6 The director of the department of natural resources shall 2 7 enter into a memorandum of agreement with the United States 2 8 department of agriculture, animal damage control division. 2 9 The wild animal depredation unit shall serve and act as the 2 10 liaison to the department for the producers in the state who 2 11 suffer crop and nursery damage due to wild animals. The 2 12 department shall issue depredation permitsas necessary to2 13reduceto any landowner who incurs crop and nursery damage of 2 14 one thousand dollars or more due to wild animals. The 2 15 criteria for issuing depredation permits shall be established 2 16 in administrative rules in consultation with the farmer 2 17 advisory committee created in section 481A.10A. The 2 18 administrative rules adopted pursuant to this section shall 2 19 not require a producer to erect or maintain fencing at a cost 2 20 exceeding one thousand dollars as a requisite for receiving a 2 21 depredation permit or for participation in a depredation plan. 2 22 Sec. 5. Section 483A.8, subsection 3, Code 1997, is 2 23 amended to read as follows: 2 24 3. A nonresident deer hunter is required to have only a 2 25 nonresident deer license and a wildlife habitat stamp. The 2 26 commission shall annually limit tofiveseven thousand five 2 27 hundred licenses the number of nonresidents allowed to have 2 28 deer hunting licenses. Of the first six thousand nonresident 2 29 deer licenses issued, not more than thirty-five percent of the 2 30 licenses shall be bow season licenses and, after the first six 2 31 thousand nonresident deer licenses have been issued, all 2 32 additional licenses shall be issued for antlerless deer only. 2 33 The number of nonresident deer hunting licenses shall be 2 34 determined as provided in section 481A.38. The commission 2 35 shall allocate the nonresident deer hunting licenses issued 3 1 among the zones based on the populations of deer. However, a 3 2 nonresident applicant may request one or more hunting zones, 3 3 in order of preference, in which the applicant wishes to hunt. 3 4 If the request cannot be fulfilled, the applicable fees shall 3 5 be returned to the applicant. A nonresident applying for a 3 6 deer hunting license must exhibit proof of having successfully 3 7 completed a hunter safety and ethics education program as 3 8 provided in section 483A.27 or its equivalent as determined by 3 9 the department before the license is issued. 3 10 Sec. 6. Section 483A.8, Code 1997, is amended by adding 3 11 the following new subsection: 3 12 NEW SUBSECTION. 4. The commission may provide, by rule, 3 13 for the issuance of an additional antlerless deer license to a 3 14 person who has been issued an antlerless deer license. The 3 15 rules shall specify the number of additional antlerless deer 3 16 licenses which may be issued, and the season and zone in which 3 17 the license is valid. The fee for an additional antlerless 3 18 deer license shall be ten dollars for residents. 3 19 Sec. 7. EFFECTIVE DATE.
