PAG LIN 1 1 Section 1. Section 34A.6A, Code 1997, is amended to read 1 2 as follows: 1 3 34A.6A ALTERNATIVE SURCHARGE. 1 4 Notwithstanding section 34A.6, the board mayrequestdo 1 5 either of the following: 1 6 1. Request imposition of a surcharge in an amount up to 1 7 two dollars and fifty cents per month on each telephone access 1 8 line. The board shall submit the question of the surcharge 1 9 under this subsection to voters in the same manner as provided 1 10 in section 34A.6. If approved, the surcharge may be collected 1 11 for a period of twenty-four months. At the end of the twenty- 1 12 four-month period, the rate of the surcharge shall revert to 1 13 one dollar per month, per access line. 1 14 2. Vote to impose a surcharge in an amount up to one 1 15 dollar per month on each telephone access line, which is in 1 16 addition to any surcharge imposed pursuant to section 34A.6. 1 17 Upon voting to impose the surcharge, the board shall conduct 1 18 two public hearings on the issue of the surcharge and the 1 19 amount approved by the board. The second public hearing shall 1 20 be conducted not less than five or more than ten days after 1 21 the first public hearing. Notice of the time and place for 1 22 each public hearing shall be published as provided in section 1 23 331.305. The notice shall indicate the boundaries of the E911 1 24 service area which would be subject to the surcharge, if 1 25 implemented. If, within ten days after the second public 1 26 hearing, a petition is filed signed by no less than ten 1 27 percent of the eligible voters in the E911 service area 1 28 requesting a referendum, the board shall submit the question 1 29 of the surcharge to voters in the same manner as provided in 1 30 section 34A.6. If a petition is not filed as provided in this 1 31 subsection, the board may impose the E911 service surcharge as 1 32 initially approved by the board after a second approval by a 1 33 simple majority vote of the voting members of the board. 1 34 EXPLANATION 1 35 This bill provides that a joint E911 service board may vote 2 1 to impose a surcharge in an amount up to $1 per month per 2 2 telephone access line. Upon taking such vote, the board is to 2 3 conduct two public hearings on the issue of the surcharge as 2 4 approved by the board. If, within 10 days after the second 2 5 public hearing, a petition requesting a referendum on the 2 6 surcharge is filed with the signatures of no less than 10 2 7 percent of the eligible voters in the E911 service area, the 2 8 board must submit the question of the surcharge to the voters 2 9 in the same manner as provided for the current surcharge 2 10 provision. If a petition is not filed, the board may impose 2 11 the proposed surcharge if approved by a simple majority vote 2 12 of the voting members of the board. 2 13 The alternative surcharge created in this bill is in 2 14 addition to the regular surcharge provided for in Code section 2 15 34A.6 which may be imposed only after approval of the voters 2 16 of the E911 service area, and is an alternative to the 2 17 alternative surcharge which may be assessed in an amount up to 2 18 $2.50 per telephone access line after approval of the voters 2 19 of the E911 service area. 2 20 LSB 3749HH 77 2 21 mj/sc/14
