1 1 Section 1. NEW SECTION. 135.37A BODY PIERCING PERMIT
1 2 REQUIRED PENALTY.
1 3 1. A person shall not own, control and lease, act as an
1 4 agent for, conduct, manage, or operate an establishment to
1 5 engage in the practice of body piercing without first applying
1 6 for and receiving a permit from the Iowa department of public
1 7 health. For the purposes of this section, "body piercing"
1 8 means the piercing of the human body, other than the ear lobe,
1 9 for purposes of ornamentation or pursuant to religious or
1 10 cultural tradition.
1 11 2. A minor shall not undergo body piercing, other than
1 12 piercing of the ear lobe, and a person shall not perform body
1 13 piercing upon a minor, without the consent of a parent or
1 14 guardian. For the purposes of this section, "minor" means an
1 15 unmarried person who is under the age of eighteen years.
1 16 3. A person who fails to meet the requirements of
1 17 subsection 1 or a person who performs body piercing upon a
1 18 minor is guilty of a serious misdemeanor.
1 19 4. The Iowa department of public health shall:
1 20 a. Adopt rules pursuant to chapter 17A and establish,
1 21 collect, and retain all fees necessary to administer this
1 22 section. The provisions of chapter 17A, including licensing
1 23 provisions, judicial review, and appeal, shall apply to this
1 24 chapter.
1 25 b. Establish minimum safety and sanitation standards for
1 26 the operation of body piercing establishments.
1 27 c. Establish minimum standards for individuals performing
1 28 body piercing.
1 29 5. If the Iowa department of public health determines that
1 30 a provision of this section or a rule or standard adopted or
1 31 established pursuant to this section has been or is being
1 32 violated, the department shall have the authority to order
1 33 that a body piercing establishment not be operated until the
1 34 necessary corrective action has been taken. If the
1 35 establishment continues to be operated in violation of the
2 1 order of the department, the department may request that the
2 2 county attorney or the attorney general make an application in
2 3 the name of the state to the district court of the county in
2 4 which the violations have occurred for an order to enjoin the
2 5 violations. This remedy is in addition to any other legal
2 6 remedy available to the department.
2 7 6. The provisions of this section shall not apply to
2 8 persons who perform body piercing pursuant to a recognized
2 9 religious doctrine or cultural practice upon persons for whom
2 10 the undergoing of body piercing has religious or cultural
2 11 significance. The performance of body piercing pursuant to
2 12 this subsection shall, however, be subject to review by the
2 13 Iowa department of public health regarding the existence of an
2 14 asserted religious doctrine or cultural practice, and whether
2 15 minimum safety and sanitation standards are being observed.
