  1  4 RELATING TO ENERGY CONSERVATION INCLUDING MAKING APPROPRI-
  1  5    ATIONS OF PETROLEUM OVERCHARGE FUNDS AND PROVIDING FOR
  1  6    THE DISSOLUTION OF THE ENERGY FUND DISBURSEMENT COUNCIL
  1  7    AND INTERMODAL REVOLVING LOAN FUND.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  There is appropriated from those funds
  1 12 designated within the energy conservation trust created in
  1 13 section 473.11, for disbursement pursuant to section 473.11,
  1 14 to the following named agencies for the fiscal year beginning
  1 15 July 1, 1998, and ending June 30, 1999, the following amounts,
  1 16 or so much thereof as is necessary, to be used for the
  1 17 purposes designated:
  1 18    1.  To the division of community action agencies of the
  1 19 department of human rights for qualifying energy conservation
  1 20 programs for low-income persons, including but not limited to
  1 21 energy weatherization projects, which target the highest
  1 22 energy users, and including administrative costs:
  1 23    a.  To be expended first from the office of hearings and
  1 24 appeals second-stage settlement (OHA) fund and then the
  1 25 Warner/Imperial and Stripper Well funds:  
  1 26 .................................................. $    400,000
  1 27    b.  To be expended from the Diamond Shamrock fund:  
  1 28 .................................................. $    300,000
  1 29    2.  To the department of natural resources for the
  1 30 following purposes:
  1 31    a.  For the state energy program, from the Exxon fund:  
  1 32 .................................................. $    115,000
  1 33    b.  For administration of petroleum overcharge programs
  1 34 from the Stripper Well fund, not to exceed the following
  1 35 amount:  
  2  1 .................................................. $    200,000
  2  2    3.  To the state department of transportation for deposit
  2  3 into the intermodal revolving loan fund established in the
  2  4 department from funds previously advanced to and repaid by the
  2  5 department from the Exxon fund:  
  2  6 .................................................. $    725,000
  2  7    The intermodal revolving loan fund shall remain in
  2  8 existence until June 30, 2019.
  2  9    Notwithstanding section 8.33, the unencumbered or
  2 10 unobligated moneys remaining at the end of any fiscal year
  2 11 from the appropriations made in subsections 1, 2, and 3 shall
  2 12 not revert but shall be available for expenditure during
  2 13 subsequent fiscal years until expended for the purposes for
  2 14 which originally appropriated.
  2 15    Sec. 2.  Section 473.11, Code 1997, is amended by adding
  2 16 the following new subsection:
  2 17    NEW SUBSECTION.  7.  On June 30, 2003, the energy fund
  2 18 disbursement council established in subsection 3 shall be
  2 19 dissolved.  At that time, the department of natural resources
  2 20 shall be responsible for the disbursement of any funds either
  2 21 received or remaining in the energy conservation trust.  These
  2 22 disbursements shall be for projects and programs consistent
  2 23 with the allowable uses for the energy conservation trust.
  2 24 Also, at that time, and annually thereafter, the state
  2 25 department of transportation shall report to the department of
  2 26 natural resources on the status of the intermodal revolving
  2 27 loan fund established in the department.  In the fiscal year
  2 28 beginning July 1, 2019, the department of natural resources
  2 29 shall assume responsibility for funds remaining in the
  2 30 intermodal revolving loan fund and disburse them for energy
  2 31 conservation projects and programs consistent with the
  2 32 allowable uses for the energy conservation trust.
  2 33    Sec. 3.  1993 Iowa Acts, chapter 11, section 3, is
  2 34 repealed.
