  1  1    Section 1.  DEFINITIONS.  As used in this Act, unless the
  1  2 context otherwise requires:
  1  3    1.  "Extension services" means the Iowa cooperative
  1  4 extension service in agriculture and home economics at Iowa
  1  5 state university of science and technology.
  1  6    2.  "Director" means the study director appointed by the
  1  7 director of the extension service.
  1  8    Sec. 2.  EXTENSION SERVICE STUDY – STUDY COMPLETION.
  1  9    1.  The extension service shall conduct a comprehensive
  1 10 legal and factual study of gambling in this state and existing
  1 11 policies and practices with respect to the legalization or
  1 12 prohibition of gambling activities and formulate and propose
  1 13 changes in those policies and practices as the extension
  1 14 service deems appropriate.  The extension service may seek the
  1 15 cooperation of other states and tribal councils in obtaining
  1 16 information regarding gambling activities within those
  1 17 jurisdictions.
  1 18    2.  The study shall include, but is not limited to, the
  1 19 following matters:
  1 20    a.  The economic impact of gambling on the state of Iowa,
  1 21 political subdivisions of this state, and native American
  1 22 tribes conducting gambling activities in this state.
  1 23    b.  The economic impact of gambling on other businesses.
  1 24    c.  An assessment and review of the political contributions
  1 25 and influences of gambling businesses and promoters on the
  1 26 development of public policy regulating gambling.
  1 27    d.  An assessment of the relationship between gambling and
  1 28 crime.
  1 29    e.  An assessment of the impact of pathological or problem
  1 30 gambling on individuals, families, social institutions,
  1 31 criminal activity, and the economy.
  1 32    f.  A review of the demographics of gamblers.
  1 33    g.  A review of the effectiveness of existing practices in
  1 34 law enforcement, judicial administration, and corrections to
  1 35 combat and deter illegal gambling and illegal activities
  2  1 related to gambling.
  2  2    h.  A review of the costs and effectiveness of state and
  2  3 federal gambling regulatory policy.
  2  4    i.  Other relevant issues and topics as considered
  2  5 appropriate by the extension service.
  2  6    3.  The extension service shall complete its study and
  2  7 submit its final report to the governor and the general
  2  8 assembly not later than January 31, 2000.  The final report
  2  9 shall contain a detailed statement of the findings and
  2 10 conclusions of the extension service with its recommendations
  2 11 for legislation and administrative actions as the extension
  2 12 service deems appropriate.
  2 13    Sec. 3.  POWERS OF THE DIRECTOR.
  2 14    1.  The director may hold hearings, administer oaths, take
  2 15 testimony, receive evidence, and require by subpoena the
  2 16 attendance and testimony of witnesses and the production of
  2 17 materials as the director considers advisable to carry out the
  2 18 purposes of this Act.
  2 19    A subpoena of the extension service shall be served in the
  2 20 manner provided for a subpoena issued by a district court
  2 21 under the Iowa rules of civil procedure.  A subpoena may be
  2 22 served anywhere in the judicial district in which the person
  2 23 required to be served resides or may be found.  A subpoena
  2 24 shall state the time and place a person is required to appear,
  2 25 be signed by the director, and be attested to by the director
  2 26 of the extension service.
  2 27    2.  Upon request of the director, the head of any state
  2 28 agency shall furnish the director with the information
  2 29 considered necessary by the director to carry out the
  2 30 provisions of this Act.
  2 31    3.  The director of the extension service shall appoint and
  2 32 terminate the employment of a director of the study and any
  2 33 additional personnel as may be necessary to carry out the
  2 34 study.
  2 35    Sec. 4.  STUDY APPROPRIATION.
  3  1    1.  There is appropriated from the general fund of the
  3  2 state to Iowa state university of science and technology the
  3  3 sum of $50,000, or so much thereof as is necessary, to fund a
  3  4 comprehensive factual and legal study of gambling in this
  3  5 state to be conducted by the Iowa cooperative extension
  3  6 service in agriculture and home economics as provided in this
  3  7 Act.
  3  8    2.  Notwithstanding section 8.33, all unobligated or
  3  9 unencumbered moneys remaining on January 31, 2000, from the
  3 10 appropriation made in subsection 1, shall revert to the
  3 11 general fund of the state on April 1, 2000.
  3 12    Sec. 5.  EFFECTIVE DATE.  This Act, being deemed of
  3 13 immediate importance, takes effect upon enactment.  
  3 14                           EXPLANATION
  3 15    This bill provides for a state gambling impact and policy
  3 16 study to be conducted by the Iowa cooperative extension
  3 17 service in agriculture and home economics.  The purpose of the
  3 18 study is to conduct a comprehensive legal and factual study of
  3 19 gambling in this state and existing policies and practices
  3 20 with respect to the legalization or prohibition of gambling
  3 21 activities, and to formulate and propose changes in those
  3 22 policies.
  3 23    The bill specifies the various study components including,
  3 24 but not limited to, the following:
  3 25    1.  Economic impact on state and local government and
  3 26 native American tribal councils.
  3 27    2.  Economic impact on other businesses.
  3 28    3.  Assessment of the influence of gambling interests on
  3 29 public policy relating to the regulation of gambling.
  3 30    4.  Assessment of the relationship between gambling and
  3 31 crime.
  3 32    5.  Assessment of the impact of pathological or problem
  3 33 gambling on individuals, families, social institutions, and
  3 34 others.
  3 35    6.  Review of the effectiveness of existing practices in
  4  1 law enforcement, judicial administration, and corrections.
  4  2    The extension service is empowered to hold hearings,
  4  3 administer oaths, take testimony, and if necessary, require
  4  4 attendance and testimony by subpoena.  The director of the
  4  5 extension service shall appoint a study director and other
  4  6 staff as necessary.
  4  7    The study report is to be completed and submitted to the
  4  8 governor and the general assembly not later than January 31,
  4  9 2000.
  4 10    An appropriation of $50,000 is provided for the study.
  4 11    This bill takes effect upon enactment.
