  1  1    Section 1.  Section 455B.364, Code 1997, is amended to read
  1  2 as follows:
  1  3    455B.364  PENALTY.
  1  4    Any person violating the provisions of section 455B.363,
  1  5 upon conviction, shall be is guilty of a simple serious
  1  6 misdemeanor which shall be punishable by a fine of five
  1  7 hundred dollars.  The court, in lieu of or in addition to any
  1  8 other sentence imposed, may direct and supervise a labor of
  1  9 litter gathering.  
  1 10                           EXPLANATION
  1 11    This bill amends the penalty for violating Code section
  1 12 455B.363 which relates to discarding litter onto or in any
  1 13 water or land of this state.  Currently, a person violating
  1 14 this Code section is guilty of a simple misdemeanor.  The bill
  1 15 amends the penalty to a serious misdemeanor punishable by a
  1 16 $500 fine.
