  1  1    Section 1.  Section 34A.3, subsection 1, unnumbered
  1  2 paragraph 1, Code 1997, is amended to read as follows:
  1  3    The board of supervisors of each county shall establish a
  1  4 joint 911 service board not later than January 1, 1989.  Each
  1  5 political subdivision of the state having a public safety
  1  6 agency serving territory within the county is entitled to
  1  7 voting membership on the joint 911 service board.  Each
  1  8 private public safety agency operating within the area is
  1  9 entitled to nonvoting voting membership on the board.  A
  1 10 township which does not operate its own public safety agency,
  1 11 but contracts Each private safety agency under contract with a
  1 12 political subdivision within the county for the provision of
  1 13 public safety services, is not entitled to membership on the
  1 14 joint 911 service board, but its contractor is entitled to
  1 15 membership according to the contractor's status as a public or
  1 16 private safety agency is entitled to voting membership on the
  1 17 board.  The board of supervisors of the county establishing
  1 18 the board is also entitled to voting membership on the board.
  1 19 The joint 911 service board shall develop an enhanced 911
  1 20 service plan encompassing at minimum the entire county, unless
  1 21 an exemption is granted by the administrator permitting a
  1 22 smaller E911 service area.  The administrator may grant a
  1 23 discretionary exemption from the single county minimum service
  1 24 area requirement based upon an E911 joint service board's or
  1 25 other E911 service plan operating authority's presentation of
  1 26 evidence which supports the requested exemption if the
  1 27 administrator finds that local conditions make adherence to
  1 28 the minimum standard unreasonable or technically infeasible,
  1 29 and that the purposes of this chapter would be furthered by
  1 30 granting an exemption.  The minimum size requirement is
  1 31 intended to prevent unnecessary duplication of public safety
  1 32 answering points and minimize other administrative, personnel,
  1 33 and equipment expenses.  An E911 service area must encompass a
  1 34 geographically contiguous area.  No exemption shall be granted
  1 35 from the contiguous area requirement.  The administrator may
  2  1 order the inclusion of a specific territory in an adjoining
  2  2 E911 service plan area to avoid the creation by exclusion of a
  2  3 territory smaller than a single county not serviced by
  2  4 surrounding E911 service plan areas upon request of the joint
  2  5 911 service board representing the territory.  The E911
  2  6 service plan operating authority shall submit the plan on or
  2  7 before January 1, 1994, to all of the following:  
  2  8                           EXPLANATION
  2  9    This bill amends the membership of the 911 service board
  2 10 established in each county.  The bill provides that each
  2 11 political subdivision, each public safety agency in the
  2 12 county, each private safety agency under contract with a
  2 13 political subdivision within the county, and the board of
  2 14 supervisors is entitled to voting membership on the board.
  2 15    Currently, each political subdivision having a public
  2 16 safety agency serving territory within the county is entitled
  2 17 to a voting membership and each private safety agency is
  2 18 entitled to a nonvoting membership.  A township which does not
  2 19 operate its own public safety agency, but contracts for such
  2 20 services, is not entitled to membership on the board, but the
  2 21 contractor is entitled to membership according to the
  2 22 contractor's status as a public or private safety agency.
