1 1 Section 1. NEW SECTION. 356.15A ESCAPED PRISONERS –
1 2 HEALTH CARE EXPENSES.
1 3 An entity, other than the entity responsible for the jail,
1 4 alternative jail, county detention facility, or municipal
1 5 holding facility to or in which a prisoner has been committed,
1 6 detained, or confined, which apprehends the prisoner following
1 7 an escape, is not liable for payment of any charges and
1 8 expenses for health care provided to the prisoner during the
1 9 time that the prisoner is not confined by the facility to or
1 10 in which the prisoner is committed, detained, or confined.
1 11 Payment of such charges shall be made from moneys in the
1 12 general fund of the state not otherwise appropriated.
1 13 Sec. 2. NEW SECTION. 904.320 ESCAPED INMATES – HEALTH
1 14 CARE EXPENSES.
1 15 An entity, other than the department of corrections, which
1 16 apprehends an inmate following an escape, is not liable for
1 17 payment of any charges and expenses for health care provided
1 18 to the inmate during the time that the inmate is not confined
1 19 by the state correctional institution to or in which the
1 20 inmate is committed or detained.
1 21 EXPLANATION
1 22 This bill provides that an entity, other than the facility
1 23 to or in which a prisoner has been committed, detained, or
1 24 confined, or the department of corrections relative to an
1 25 inmate committed to or detained in a state correctional
1 26 institution, which apprehends an escaped prisoner or inmate,
1 27 is not liable for payment of any charges or expenses for
1 28 health care provided to the escapee during the time that
1 29 prisoner or inmate is an escapee. Any such charges with
1 30 respect to inmates under the control of the department of
1 31 corrections are to be paid from the general fund of the state.
