PAG LIN 1 1 HOUSE FILE 2135 1 2 1 3 AN ACT 1 4 RELATING TO A MID-AMERICA PORT COMMISSION AGREEMENT AND 1 5 PROVIDING AN EFFECTIVE DATE. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. NEW SECTION. 28K.1 MID-AMERICA PORT 1 10 COMMISSION AGREEMENT. 1 11 The mid-America port commission agreement is entered into 1 12 and enacted into law with the state of Illinois and the state 1 13 of Missouri if those states legally join the agreement, in the 1 14 form substantially as follows: 1 15 AGREEMENT 1 16 This agreement shall be known as and may be cited as the 1 17 "Mid-America Port Commission Agreement". This agreement 1 18 allows for the states of Missouri and Illinois to join the 1 19 effort of the state of Iowa for developing the mid-America 1 20 port commission. 1 21 PORT COMMISSION 1 22 There is created a mid-America port commission to be 1 23 governed by a nine-member port commission. The governors of 1 24 Iowa, Illinois, and Missouri shall appoint one member to the 1 25 port commission in accordance with the laws of the respective 1 26 state. Each state shall also be represented by two members 1 27 elected through the county governance in the geographical 1 28 jurisdiction of the port commission. The port commission 1 29 members shall hold office for a period of six years. The port 1 30 commission members shall elect a chairperson of the port 1 31 commission after all the members are selected. The position 1 32 of chairperson shall rotate among the Iowa, Illinois, and 1 33 Missouri members for two-year periods. A member of the port 1 34 commission shall not serve more than two terms. 1 35 POWERS OF COMMISSION 2 1 The port commission shall have the power to acquire, 2 2 purchase, install, lease, construct, own, hold, maintain, 2 3 equip, use, control, or operate ports, harbors, waterways, 2 4 channels, wharves, piers, docks, quays, elevators, tipples, 2 5 compresses, bulk loading and unloading facilities, warehouses, 2 6 dry docks, marine support railways, tugboats, ships, vessels, 2 7 shipyards, shipbuilding facilities, machinery and equipment, 2 8 dredges, or any other facilities required or incidental to the 2 9 construction, outfitting, dry docking, or repair of ships or 2 10 vessels, or water, air, or rail terminals, or roadways or 2 11 approaches thereto, or other structures or facilities 2 12 necessary for the convenient use of the same in the aid of 2 13 commerce, including the dredging, deepening, extending, 2 14 widening, or enlarging of any ports, harbors, rivers, 2 15 channels, or waterways, the damming of inland waterways, the 2 16 establishment of a water basin, the acquisition and 2 17 development of industrial sites, or the reclaiming of 2 18 submerged lands. 2 19 Sec. 2. NEW SECTION. 28K.2 CITATION. 2 20 This division shall be known and may be cited as the "Mid- 2 21 America Port Commission Act". 2 22 Sec. 3. NEW SECTION. 28K.3 JURISDICTION. 2 23 The Iowa counties which shall be included in the 2 24 jurisdiction of the mid-America port commission agreement are 2 25 Lee, Henry, and Des Moines counties. 2 26 Sec. 4. NEW SECTION. 28K.4 AUTHORITY. 2 27 Any power or powers, privileges, or authority exercised or 2 28 capable of exercise by a public agency of this state may be 2 29 exercised and enjoyed jointly with the mid-America port 2 30 commission according to the powers delegated to the commission 2 31 under this chapter. 2 32 A public agency of this state may enter into a chapter 28E 2 33 agreement with the commission to advance the purposes of the 2 34 commission. 2 35 Sec. 5. NEW SECTION. 28K.5 COUNTY ELECTION OF PORT 3 1 COMMISSION MEMBERS. 3 2 The chairpersons of the Lee, Henry, and Des Moines county 3 3 boards of supervisors shall jointly elect two members to serve 3 4 on the port commission. 3 5 Sec. 6.
