PAG LIN 1 1 Section 1. NEW SECTION. 257.13 ON-TIME FUNDING FOR NEW 1 2 STUDENTS. 1 3 1. If a district's actual enrollment for the budget year, 1 4 determined under section 257.6, is greater than its budget 1 5 enrollment for the budget year, the district may submit a 1 6 request to the school budget review committee for on-time 1 7 funding for new students. The school budget review committee 1 8 shall consider the relative increase in enrollment on a 1 9 district-by-district basis, in determining whether to approve 1 10 the request, and shall determine the amount of additional 1 11 funding to be provided if the request is granted. An 1 12 application for on-time funding must be received by the 1 13 department of education by October 1. Written notice of the 1 14 committee's decision shall be given through the department of 1 15 education to the school board for a district. 1 16 2. If the school budget review committee approves a 1 17 request for on-time funding for new students, the funding 1 18 shall be in an amount up to the product of one-third of the 1 19 state cost per pupil for the budget year multiplied by the 1 20 difference between the actual enrollment for the budget year 1 21 and the budget enrollment for the budget year. The additional 1 22 funding received under this section is miscellaneous income to 1 23 the district. 1 24 3. There is appropriated each fiscal year from the general 1 25 fund of the state to the department of education up to six 1 26 million dollars to pay additional funding authorized under 1 27 this section, which shall be paid to school districts in 1 28 monthly installments beginning on December 15 and ending on 1 29 June 15 of a budget year. If the requests approved by the 1 30 school budget review committee exceed the appropriation in 1 31 this subsection, the payments to school districts receiving 1 32 approval for on-time funding shall be prorated such that each 1 33 school district approved for on-time funding shall receive an 1 34 amount of on-time funding equal to the percentage that the on- 1 35 time funding to be provided to the district bears to the total 2 1 amount of on-time funding to be provided to all districts 2 2 receiving approval. 2 3 4. If the board of directors of a school district 2 4 determines that a need exists for additional funds exceeding 2 5 the amount provided in this section, a request for 2 6 supplemental aid based upon increased enrollment may be 2 7 submitted to the school budget review committee as provided in 2 8 section 257.31. 2 9 5. A school district which is receiving a budget 2 10 adjustment for a budget year pursuant to section 257.14 shall 2 11 not be eligible to receive on-time funding for new students 2 12 for that budget year. 2 13 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 2 14 immediate importance, takes effect upon enactment for the 2 15 purpose of computations required for payment of state aid to 2 16 school districts for budget years beginning on or after July 2 17 1, 1998. This Act remains in effect until the repeal of 2 18 chapter 257 on July 1, 2001. 2 19 EXPLANATION 2 20 This bill provides that school districts experiencing 2 21 increases in enrollment may submit a request to the school 2 22 budget review committee for on-time funding for new students 2 23 by October 1 annually. The school budget review committee 2 24 shall determine whether, and to what extent, a request shall 2 25 be granted on a district-by-district basis. If a request is 2 26 approved, the funding shall be in an amount of up to the 2 27 product of one-third of the state cost per pupil for the 2 28 budget year multiplied by the difference between the actual 2 29 enrollment for the budget year and the budget enrollment for 2 30 the budget year. 2 31 The bill makes an appropriation from the general fund of 2 32 the state to the department of education of up to $6 million 2 33 annually, payable in installments to school districts 2 34 beginning on December 15 and ending on June 15 of a budget 2 35 year. If requests for on-time funding exceed the 3 1 appropriation available, school districts with approved 3 2 requests shall receive prorated payments. School districts 3 3 may request supplemental and above and beyond amounts received 3 4 for on-time funding pursuant to Code section 257.31. The bill 3 5 would become law upon enactment and remains in effect until 3 6 the repeal of Code chapter 257 on July 1, 2001. 3 7 LSB 3399HH 77 3 8 rn/jl/8
