1 4 PROHIBITING THE USE OF SELF-SERVICE DISPLAYS IN THE OFFERING
1 5 FOR SALE OR SALE OF CIGARETTES OR TOBACCO PRODUCTS, AND
1 6 PROVIDING A PENALTY.

1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 10 Section 1. LEGISLATIVE INTENT. It is the intent of the
1 11 general assembly to restrict access of minors to cigarettes
1 12 and tobacco products by limiting self-service sales and self-
1 13 service displays of cigarettes and tobacco products. This Act
1 14 is necessary because of the widespread problem of access of
1 15 minors to cigarettes and tobacco products through unsupervised
1 16 sales and shoplifting. The general assembly recognizes that a
1 17 large percentage of adult smokers begin smoking before they
1 18 can legally purchase tobacco products. Cigarette smoking is
1 19 responsible for hundreds of thousands of deaths each year and
1 20 thousands of minors start smoking each day. The overall
1 21 purpose of this Act is to protect the health and welfare of
1 22 the citizens of this state.
1 23 Sec. 2. Section 453A.1, Code 1997, is amended by adding
1 24 the following new subsections:
1 25 NEW SUBSECTION. 1A. "Carton" means a box or container of
1 26 any kind in which ten or more packages or packs of cigarettes
1 27 or tobacco products are offered for sale, sold, or otherwise
1 28 distributed to consumers.
1 29 NEW SUBSECTION. 15A. "Package" or "pack" means a
1 30 container of any kind in which cigarettes or tobacco products
1 31 are offered for sale, sold, or otherwise distributed to
1 32 consumers.
1 33 NEW SUBSECTION. 20A. "Self-service display" means any
1 34 manner of product display, placement, or storage from which a
1 35 person purchasing the product may take possession of the
2 1 product, prior to purchase, without assistance from the
2 2 retailer or employee of the retailer, in removing the product
2 3 from a restricted access location.
2 4 Sec. 3. NEW SECTION. 453A.36A SELF-SERVICE SALES
2 5 PROHIBITED.
2 6 1. Beginning January 1, 1999, except as provided in
2 7 section 453A.36, subsection 6, a retailer shall not sell or
2 8 offer for sale cigarettes or tobacco products, in a quantity
2 9 of less than a carton, through the use of a self-service
2 10 display.
2 11 2. Violation of this section by a holder of a retail
2 12 permit is grounds for revocation of such permit.
