  1  1    Section 1.  Section 331.438, subsection 1, Code Supplement
  1  2 1997, is amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  d.  "Traumatic brain injury" means
  1  4 clinically evident brain damage or spinal cord injury
  1  5 resulting directly or indirectly from trauma not primarily
  1  6 related to degenerative or aging processes, which temporarily
  1  7 or permanently impairs a person's physical or cognitive
  1  8 functions.
  1  9    Sec. 2.  Section 331.439, Code Supplement 1997, is amended
  1 10 by adding the following new subsection:
  1 11    NEW SUBSECTION.  9.  A county's management plans submitted
  1 12 under this section shall address the service needs of persons
  1 13 with traumatic brain injury.  Any provider of services to
  1 14 persons with traumatic brain injury included in the plans
  1 15 shall comply with the applicable service standards developed
  1 16 by the council on quality and leadership in supports for
  1 17 people with disabilities or the commission of accreditation of
  1 18 residential facilities.
  1 19    Sec. 3.  IMPLEMENTATION OF ACT.  Section 25B.2, subsection
  1 20 3, shall not apply to this Act.  
  1 21                           EXPLANATION
  1 22    This bill requires county management plans for mental
  1 23 health, mental retardation, and developmental disabilities
  1 24 services to address the service needs of persons with
  1 25 traumatic brain injury.
  1 26    The bill includes a definition of traumatic brain injury in
  1 27 Code chapter 331, relating to county home rule implementation.
  1 28 The provision requiring inclusion of traumatic brain injury
  1 29 service needs in county plans also requires the service
  1 30 providers to comply with certain national standards.
  1 31    This bill may include a state mandate as defined in Code
  1 32 section 25B.3.  This bill makes inapplicable Code section
  1 33 25B.2, subsection 3, which would relieve a political
  1 34 subdivision from complying with a state mandate if funding for
  1 35 the cost of the state mandate is not provided or specified.
  2  1 Therefore, political subdivisions are required to comply with
  2  2 any state mandate included in this bill.
