  1  1    Section 1.  Section 404.2, unnumbered paragraph 1, Code
  1  2 Supplement 1997, is amended to read as follows:
  1  3    A city or county may only exercise the authority conferred
  1  4 upon it in this chapter, subject to the limitation in section
  1  5 404.8, and after the following conditions have been met:
  1  6    Sec. 2.  NEW SECTION.  404.8  EXEMPTION LIMITATION –
  1  7 COUNTY AND SCHOOL DISTRICT APPROVAL.
  1  8    If all or a portion of an urban revitalization area
  1  9 designated by a city is located in a county or school
  1 10 district, the county or school district may choose not to
  1 11 allow an exemption for that portion of the taxes payable to
  1 12 the county or school district or may choose to allow a smaller
  1 13 exemption than that allowed by the city, under the schedule
  1 14 set out in section 404.3, subsection 1, 2, 3, or 4.  If all or
  1 15 a portion of an urban revitalization area designated by a
  1 16 county is located in a school district, the school district
  1 17 may choose not to allow an exemption for that portion of the
  1 18 taxes payable to the school district or may choose to allow a
  1 19 smaller exemption than that allowed by the county, under the
  1 20 schedule set out in section 404.3, subsection 1, 2, 3, or 4.
  1 21    Sec. 3.  APPLICABILITY.  This Act applies to applications
  1 22 for exemption filed on or after January 1, 1999.  
  1 23                           EXPLANATION
  1 24    The bill provides that, in the case of an urban
  1 25 revitalization area designated by a city, a school district or
  1 26 county may choose to allow no exemption from taxation or may
  1 27 allow a smaller exemption under a schedule other than that
  1 28 chosen by the city.  In the case of a revitalization area
  1 29 designated by a county, a school district may choose to allow
  1 30 no exemption or may allow a smaller exemption under a schedule
  1 31 other than that chosen by the county.
  1 32    The bill applies to applications for property tax exemption
  1 33 filed on or after January 1, 1999.
