1 1 Section 1. Section 282.18, subsection 2, Code Supplement
1 2 1997, is amended by adding the following new unnumbered
1 3 paragraph:
1 4 NEW UNNUMBERED PARAGRAPH. Notwithstanding any other
1 5 provision of this section, a request to transfer made by a
1 6 parent or guardian who has moved the family residence to this
1 7 state from another state shall be considered timely filed if
1 8 the request is received by the district of residence during
1 9 the school year in which the move occurred, or within thirty
1 10 days of the move, whichever occurs later.
1 11 EXPLANATION
1 12 This bill requires a school district of residence to
1 13 consider an open enrollment request timely filed if a parent
1 14 or guardian who has moved the family residence to Iowa from
1 15 another state files the request during the school year in
1 16 which the move occurred, or within 30 days of the move,
1 17 whichever occurs later.
1 18 Currently, the Code permits a district to accept an open
1 19 enrollment application after the January 1 deadline if "good
1 20 cause" exists. Moving the family residence from one state to
1 21 another is included under the definition of "good cause."
1 22 However, under the Iowa Administrative Code, an open
1 23 enrollment request for "good cause" must be received by a
1 24 school district on or before June 30 of the preceding school
1 25 year.
