PAG LIN 1 1 Section 1. Section 282.18, subsection 10, Code Supplement 1 2 1997, is amended to read as follows: 1 3 10. Notwithstanding section 285.1 relating to 1 4 transportation of nonresident pupils, the parent or guardian 1 5 is responsible for transporting the pupil without 1 6 reimbursement to and from a point on a regular school bus 1 7 route of the receiving district. However, a receiving 1 8 district may send school vehicles into the district of 1 9 residence of the pupil using the open enrollment option under 1 10 this section, for the purpose of transporting the pupil to and 1 11 from school in the receiving district, if the boards of both 1 12 the sending and receiving districts agree to this arrangement 1 13 or if the receiving district advances no more than two miles 1 14 into the sending district, subject to section 285.9. If the 1 15 pupil meets the economic eligibility requirements established 1 16 by the department and state board of education, the sending 1 17 district is responsible for providing transportation or paying 1 18 the pro rata cost of the transportation to a parent or 1 19 guardian for transporting the pupil to and from a point on a 1 20 regular school bus route of a contiguous receiving district 1 21 unless the cost of providing transportation or the pro rata 1 22 cost of the transportation to a parent or guardian exceeds the 1 23 average transportation cost per pupil transported for the 1 24 previous school year in the district. If the cost exceeds the 1 25 average transportation cost per pupil transported for the 1 26 previous school year, the sending district shall only be 1 27 responsible for that average per pupil amount. A sending 1 28 district which provides transportation for a pupil to a 1 29 contiguous receiving district under this subsection may 1 30 withhold from the district cost per pupil amount, that is to 1 31 be paid to the receiving district, an amount which represents 1 32 the average or pro rata cost per pupil for transportation, 1 33 whichever is less. 1 34 EXPLANATION 1 35 This bill permits a receiving district to send school 2 1 vehicles into the district of residence to transport a pupil 2 2 participating in open enrollment if the receiving district 2 3 advances no more than two miles into the sending district, 2 4 subject to the approval of the route by the area education 2 5 agency. The Code requires each area education agency to 2 6 approve all bus routes outside the boundary of the district of 2 7 the school operating the buses. 2 8 Currently, a receiving district may send school vehicles 2 9 into the district of residence in an open enrollment situation 2 10 only if both districts agree to the arrangement. 2 11 LSB 3140YH 77 2 12 kh/jw/5
