1 1 Section 1. NEW SECTION. 727.8A CRIMINAL VOYEURISM.
1 2 A person who observes or records the activity of another
1 3 person by any means commits a serious misdemeanor if all of
1 4 the following criteria are established:
1 5 a. The person has no right or authority to observe or
1 6 record the activity of the other person.
1 7 b. At the time that the observation or recording of the
1 8 activity is made, the other person is in a dwelling or
1 9 occupied structure.
1 10 c. The other person has a reasonable expectation of
1 11 privacy.
1 12 d. The other person has not consented to being observed.
1 13 EXPLANATION
1 14 This bill establishes a new serious misdemeanor offense of
1 15 criminal voyeurism. The offense occurs when a person observes
1 16 or records the activity of another person without right,
1 17 authority, or consent and the other person is in a dwelling or
1 18 occupied structure and has a reasonable expectation of
1 19 privacy. A serious misdemeanor is punishable by imprisonment
1 20 not to exceed one year and a fine of at least $250 but not
1 21 more than $1,500.
