PAG LIN 1 1 Section 1. Section 252B.15, Code 1997, is amended by 1 2 adding the following new subsection: 1 3 NEW SUBSECTION. 3. If requested by the obligor, child 1 4 support payments made to the collection services center in 1 5 accordance with an order being enforced by the unit for an 1 6 individual not eligible for enforcement services as a public 1 7 assistance recipient, and child support payments made to the 1 8 clerk of the district court pursuant to a court order or 1 9 judgment, shall be disbursed to the appropriate individual by 1 10 direct deposit of the support payments in a customer asset 1 11 account, as defined in section 527.2, established by the 1 12 individual as required by this subsection. The individual 1 13 named as the recipient of the support payments on behalf of 1 14 the child shall establish a customer asset account for the 1 15 exclusive purposes of deposit of support payments received and 1 16 use of the moneys as authorized by this subsection, and shall 1 17 provide the account number to the collection services center 1 18 or the clerk of the district court of the county in which the 1 19 order for support is filed, as appropriate. Moneys deposited 1 20 in the customer asset account shall only be used for the 1 21 support of the child for whom support is ordered and for 1 22 payment of any fees related to the establishment and 1 23 maintenance of the account. The recipient of the support 1 24 payments shall forward a written accounting of all canceled 1 25 checks or receipts of transactions written against the account 1 26 and all receipts of withdrawal from the account on or before 1 27 January 1 of each year to the obligor. 1 28 To initiate the process under this subsection, an obligor 1 29 shall submit a written request to the collection services 1 30 center or the clerk of the district court, as applicable, on 1 31 forms provided by the collection services center or the clerk 1 32 of the district court. 1 33 A person who willfully fails to comply with this subsection 1 34 may be cited and punished by the court for contempt and be 1 35 committed to the county jail for a period of time not to 2 1 exceed thirty days for each offense. 2 2 Sec. 2. NEW SECTION. 598.22C DISBURSEMENT OF SUPPORT 2 3 PAYMENTS. 2 4 If requested by the person obligated to pay support, child 2 5 support payments made to the collection services center in 2 6 accordance with an order being enforced by the child support 2 7 recovery unit for an individual not eligible for enforcement 2 8 services as a public assistance recipient, and child support 2 9 payments made to the clerk of the district court pursuant to a 2 10 court order or judgment, shall be disbursed to the appropriate 2 11 individual by direct deposit of the support payments in a 2 12 customer asset account, as defined in section 527.2, 2 13 established by the individual as required by this section. 2 14 The individual named as the recipient of the support payments 2 15 on behalf of the child shall establish a customer asset 2 16 account for the exclusive purposes of deposit of support 2 17 payments received and use of the moneys as authorized by this 2 18 section, and shall provide the account number to the 2 19 collection services center or to the clerk of the district 2 20 court of the county in which the order for support is filed, 2 21 as appropriate. NOTIFICATION REQUIREMENTS. The child support 3 5 recovery unit and the clerk of the district court shall notify 3 6 all recipients and payors of child support of the requirements 3 7 of this Act. 3 8 Sec. 4. EFFECTIVE DATES. 3 9 1. Sections 1 and 2 of this Act take effect January 1, 3 10 1999. 3 11 2. Section 3 of this Act, being deemed of immediate 3 12 importance, takes effect upon enactment. 3 13 EXPLANATION 3 14 This bill requires that if requested to do so by the person 3 15 obligated to pay support the collection services center in 3 16 disbursing child support payments received in accordance with 3 17 an order being enforced by the child support recovery unit for 3 18 an individual not eligible for enforcement services as a 3 19 public assistance recipient and the clerk of the district 3 20 court dispersing child support payments collected in 3 21 accordance with a support order filed in that county are only 3 22 to disburse payments through direct deposit of the support in 3 23 a customer asset account established by the recipient of the 3 24 support for the exclusive purposes of depositing of the 3 25 support payments and use of such deposits for the support of 3 26 the child. Moneys in the account shall only be used for 3 27 support of the child and payment of fees related to the 3 28 account. The recipient of the support payments is required to 3 29 provide the collection services center or the clerk of the 3 30 district court, as appropriate, with the account number and is 3 31 also required to provide the obligor with a written accounting 3 32 of all canceled checks and other receipts of transactions 3 33 written against the account and all receipts of withdrawal 3 34 from the account. The person obligated to pay support must 3 35 submit a written request to the collection services center or 4 1 the clerk of the district court to initiate the process. The 4 2 bill also provides for the citing of a person with contempt of 4 3 court for violating the requirements of the bill. The bill 4 4 also requires that the collection services center and the 4 5 clerk of the district court notify all recipients and payors 4 6 of child support of the requirements of the bill upon 4 7 enactment, and provides that the other requirements of the 4 8 bill are effective January 1, 1999. 4 9 LSB 3152YH 77 4 10 pf/sc/14.1
