1 1 Section 1. NEW SECTION. 598.41A VISITATION – HISTORY OF
1 2 CRIMINAL OFFENSES AGAINST A MINOR.
1 3 Notwithstanding section 598.41, the court shall consider in
1 4 the award of visitation rights to a parent of a child, the
1 5 criminal history of the parent if the parent has been
1 6 convicted of a criminal offense against a minor, a sexually
1 7 violent offense against a minor, or sexual exploitation of a
1 8 minor. As used in this section, "criminal offense against a
1 9 minor", "sexually violent offense", and "sexual exploitation"
1 10 mean as defined in section 692A.1.
1 11 EXPLANATION
1 12 This bill requires the court to consider in the awarding of
1 13 child visitation rights the history of a parent who has been
1 14 convicted of a criminal offense against a minor, a sexually
1 15 violent offense against a minor, or sexual exploitation of a
1 16 minor.
