  1  1    Section 1.  Section 455B.262, subsection 1, Code 1997, is
  1  2 amended to read as follows:
  1  3    1.  It is recognized that the protection of life and
  1  4 property from floods, the prevention of damage to lands from
  1  5 floods, and the orderly development, wise use, protection, and
  1  6 conservation of the water resources of the state by their
  1  7 considered and proper use is of paramount importance to the
  1  8 welfare and prosperity of the people of the state, and to
  1  9 realize these objectives, it is the policy of the state to
  1 10 correlate and vest the powers of the state in a single agency,
  1 11 the department, with the duty and authority to assess the
  1 12 water needs of all water users at five-year intervals for the
  1 13 twenty years beginning January 1, 1985, and ending December
  1 14 31, 2004, utilizing a data base developed and managed by the
  1 15 Iowa geological survey, and to prepare a general plan of water
  1 16 allocation in this state considering the quantity and quality
  1 17 of water resources available in this state designed to meet
  1 18 the specific needs of the water users.
  1 19    a.  By July 1, 2001, the department shall submit a state
  1 20 water plan to the general assembly.  The plan must provide a
  1 21 critical review, evaluation, and analysis of the availability
  1 22 and quality of water in Iowa.  The plan shall include
  1 23 recommendations addressing the policies and programs for
  1 24 detailed, future regional, county, and local planning and
  1 25 water development projects.  At a minimum, the plan must build
  1 26 upon the 1978 Iowa water plan prepared by the Iowa natural
  1 27 resources council in July 1978, and must include a detailed
  1 28 analysis of every topic included in the 1978 Iowa water plan.
  1 29 These topics include the following:
  1 30    (1)  Water needs.
  1 31    (2)  Data base.
  1 32    (3)  Water resources availability.
  1 33    (4)  Water quality.
  1 34    (5)  Domestic, municipal, commercial, and industrial water
  1 35 supplies.
  2  1    (6)  Flood plain management.
  2  2    (7)  Water-oriented recreation, fish, and wildlife.
  2  3    (8)  Water for energy production.
  2  4    (9)  Agriculture.
  2  5    (10)  Socioeconomic, legal, and institutional aspects of
  2  6 water resources.
  2  7    (11)  Recommendations for the future.
  2  8    b.  The department shall also develop and the department
  2  9 shall adopt no later than June 30, 1986, a plan for
  2 10 delineation of flood plain and floodway boundaries for
  2 11 selected stream reaches in the various river basins of the
  2 12 state.  Selection of the stream reaches and assignment of
  2 13 priorities for mapping of the selected reaches shall be based
  2 14 on consideration of flooding characteristics, the type and
  2 15 extent of existing and anticipated flood plain development in
  2 16 particular stream reaches, and the needs of local governmental
  2 17 bodies for assistance in delineating flood plain and floodway
  2 18 boundaries.  The plan of flood plain mapping shall be for the
  2 19 period from June 30, 1986, to December 31, 2004.  After the
  2 20 department adopts a plan of flood plain mapping, the
  2 21 department shall submit a progress report and proposed
  2 22 implementation schedule to the general assembly biennially.
  2 23 The department may modify the flood plain mapping plan as
  2 24 needed in response to changing circumstances.  
  2 25                           EXPLANATION
  2 26    This bill provides new requirements for the department of
  2 27 natural resources to submit a state water plan by July 1,
  2 28 2001.  The plan must provide a critical review, evaluation,
  2 29 and analysis of the availability and quality of water in Iowa.
  2 30 At a minimum, the plan must build upon the 1978 Iowa water
  2 31 plan, include a detailed analysis of every topic included in
  2 32 the 1978 Iowa water plan, and include recommendations
  2 33 addressing policies and programs for future planning and water
  2 34 development projects.
