1 1 Section 1. NEW SECTION. 598.41A VISITATION –
1 2 RESTRICTIONS – MURDER OF PARENT.
1 3 1. Notwithstanding section 598.41, the court shall not
1 4 award visitation rights to a child's parent who has been
1 5 convicted of murder in the first degree of the other parent of
1 6 the child, unless the court finds that the child is
1 7 developmentally mature enough to provide assent and assents to
1 8 visitation.
1 9 2. Until an order regarding visitation rights is issued,
1 10 the child of a parent who has been convicted of murder in the
1 11 first degree of the other parent of the child shall not visit
1 12 the parent without the consent of the child's custodian or
1 13 legal guardian.
1 14 EXPLANATION
1 15 This bill prohibits the issuing of an order by the court
1 16 which awards visitation rights to a child's parent convicted
1 17 of murder in the first degree of the other parent of the
1 18 child, unless the court finds that the child is
1 19 developmentally mature enough to provide assent and the child
1 20 assents.
1 21 Until an order is issued, the bill provides that the child
1 22 is prohibited from visiting the convicted parent without the
1 23 consent of the child's custodian or guardian.
