PAG LIN 1 1 Section 1. Section 455F.1, subsection 4, Code 1997, is 1 2 amended to read as follows: 1 3 4. "Household hazardous material" means a product used for 1 4 residential purposes and designated by rule of the department 1 5 of natural resources and may include any hazardous substance 1 6 as defined in section 455B.411, subsection 2; and any 1 7 hazardous waste as defined in section 455B.411, subsection 3; 1 8 and shall include but is not limited to the following 1 9 materials: motor oils, motor oil filters, gasoline and diesel 1 10 additives, degreasers, waxes, polishes, pure solvents,paints,1 11with the exception of latex-based paints,lacquers, thinners, 1 12 caustic household cleaners, spot and stain remover with 1 13 petroleum base,andpetroleum-based fertilizers, and paints 1 14 with the exception of latex-based paints. However, "household 1 15 hazardous material" does not include noncaustic household 1 16 cleaners, laundry detergents or soaps, dishwashing compounds, 1 17 chlorine bleach, personal care products, personal care soaps, 1 18 cosmetics, and medications. 1 19 Sec. 2. Section 455F.8B, subsection 2, Code 1997, is 1 20 amended by striking the subsection. 1 21 Sec. 3. Section 455F.9, Code 1997, is amended to read as 1 22 follows: 1 23 455F.9 EDUCATION PROGRAM. 1 24 In addition to the "Toxic Cleanup Days" program the 1 25 department shall implement a public information and education 1 26 program regarding the use and disposal of household hazardous 1 27 materials. The program shall provide appropriate information 1 28 concerning the reduction in use of the materials, including 1 29 the purchase of smaller quantities andselection of1 30alternative productshazards associated with the use of 1 31 unregistered and unregulated alternative products. The 1 32 department shall cooperate with existing educational 1 33 institutions, the household product industry, distributors, 1 34 wholesalers, and retailers, and other agencies of government 1 35 and shall enlist the support of service organizations, 2 1 whenever possible, in promoting and conducting the programs in 2 2 order to effectuate the household hazardous materials policy 2 3 of the state. 2 4 Sec. 4. Section 455F.3, Code 1997, is repealed. 2 5 EXPLANATION 2 6 The bill amends Code section 455F.1 by changing solvents to 2 7 pure solvents in the definition of household hazardous 2 8 materials. The bill amends Code section 455F.1 by adding 2 9 noncaustic household cleaners to the list of materials which 2 10 are not considered household hazardous materials. 2 11 The bill also repeals Code section 455F.3 relating to a 2 12 labeling requirement for household hazardous materials. 2 13 Currently, that Code section requires the following: 2 14 1. A retailer is required to affix a label near a display 2 15 area of a household hazardous material, in most cases adjacent 2 16 to price information for the material. 2 17 2. The department of natural resources shall develop and 2 18 distribute a list of household hazardous products to be 2 19 utilized in the labeling of display areas. 2 20 3. A person found in violation of the section is guilty of 2 21 a simple misdemeanor. 2 22 The bill amends Code section 455F.9 relating to the 2 23 department's public information and education program on 2 24 household hazardous materials. The bill provides that the 2 25 program shall provide information concerning the reduction in 2 26 use of the materials, including the purchase of smaller 2 27 quantities, and hazards associated with the use of 2 28 unregistered and unregulated alternative products.
