  1  1    Section 1.  Section 481A.68, subsection 2, Code 1997, is
  1  2 amended to read as follows:
  1  3    2.  A person shall not use more than three tip-up fishing
  1  4 devices for fishing in the waters of the Mississippi river,
  1  5 the Missouri river, and the Big Sioux river, and its their
  1  6 connected backwater.  A person may use two or three hooks on
  1  7 the same line, but the total number of hooks used by each
  1  8 person shall not exceed three.  Each tip-up fishing device
  1  9 used in fishing shall have attached a tag plainly labeled with
  1 10 the owner's name and address.  A person shall not use a tip-up
  1 11 fishing device for fishing within three hundred feet of a dam
  1 12 or spillway or in a part of the river which is closed or
  1 13 posted against use of the device.  Three tip-up fishing
  1 14 devices may be used in addition to the two lines with no more
  1 15 than two hooks per line, as specified in section 481A.72.  
  1 16                           EXPLANATION
  1 17    This bill authorizes the use of tip-up fishing devices for
  1 18 fishing in the waters of the Missouri and Big Sioux rivers.
  1 19 Tip-up fishing devices are currently authorized for the
  1 20 Mississippi river only.  The three tip-up devices and the
  1 21 number of hooks and lines authorized for the Missouri and Big
  1 22 Sioux rivers is the same as for the Mississippi river.  Also,
  1 23 the tip-up devices must be labeled with the name and address
  1 24 of the owner.
  1 25    A violator is guilty of a simple misdemeanor with a minimum
  1 26 fine of $10.
