  1  1    Section 1.  Section 904.112, Code 1997, is amended to read
  1  2 as follows:
  1  3    904.112  INSTITUTIONAL RECEIPTS.
  1  4    All institutional Institutional receipts of the department
  1  5 of corrections shall be deposited in the general fund of the
  1  6 state except for reimbursements as follows:
  1  7    1.  Reimbursement for services provided to another
  1  8 institution or state agency, rentals charged to employees or
  1  9 other persons for room, apartment, or housing, and charges for
  1 10 meals.
  1 11    2.  Receipts which are specifically required to be
  1 12 otherwise expended or deposited under this chapter.
  1 13    Sec. 2.  Section 904.311A, Code 1997, is amended to read as
  1 14 follows:
  1 15    904.311A  PRISON RECYCLING FUND.
  1 16    The Iowa prison A recycling fund for each prison
  1 17 institution is created and established as a separate and
  1 18 distinct fund in the state treasury.  All moneys remitted to
  1 19 the department for the recycling operations in each fiscal
  1 20 year commencing with the fiscal year beginning July 1, 1994,
  1 21 of a prison institution shall be deposited in the fund
  1 22 established for that institution.  Notwithstanding section
  1 23 12C.7, subsection 2, interest or earnings on moneys deposited
  1 24 in the each fund shall be credited to the that fund.
  1 25 Notwithstanding section 8.33, moneys in the each fund shall
  1 26 not revert to the general fund of the state at the close of a
  1 27 fiscal year but shall remain in the that fund and be used as
  1 28 directed in this section in the succeeding fiscal year.  The
  1 29 treasurer of state shall act as custodian of the each fund and
  1 30 disburse moneys from the each fund as directed by the
  1 31 department for the purpose of payment of operating expenses
  1 32 for recycling.  
  1 33                           EXPLANATION
  1 34    This bill provides that institutional receipts of the
  1 35 department of corrections that are specifically otherwise
  2  1 required to be expended or deposited are not to be deposited
  2  2 in the general fund of the state.  The bill also changes the
  2  3 Iowa prison recycling fund language to provide for separate
  2  4 funds for each prison institution within the state treasury.
  2  5 Currently there is a single fund for all institutions.
