PAG LIN 1 1 HOUSE FILE 635 1 2 1 3 AN ACT 1 4 RELATING TO WEAPONS AND MUNITIONS BY CONSIDERING THE USE OF 1 5 LESS LETHAL MUNITIONS BY PEACE OFFICERS NOT A USE OF 1 6 DEADLY FORCE AND RELATING TO THE POSSESSION OF CURIO OR 1 7 RELIC FIREARMS BY MEMBERS OF CERTAIN ORGANIZATIONS. 1 8 1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 10 1 11 Section 1. Section 704.2, subsections 3 and 4, Code 1997, 1 12 are amended to read as follows: 1 13 3. The discharge of a firearm, other than a firearm loaded 1 14 with less lethal munitions and discharged by a peace officer, 1 15 corrections officer, or corrections official in the line of 1 16 duty, in the direction of some person with the knowledge of 1 17 the person's presence there, even though no intent to inflict 1 18 serious physical injury can be shown. 1 19 4. The discharge of a firearm, other than a firearm loaded 1 20 with less lethal munitions and discharged by a peace officer, 1 21 corrections officer, or corrections official in the line of 1 22 duty, at a vehicle in which a person is known to be. 1 23 Sec. 2. Section 704.2, Code 1997, is amended by adding the 1 24 following new unnumbered paragraph: 1 25 NEW UNNUMBERED PARAGRAPH. As used in this section, "less 1 26 lethal munitions" means projectiles which are designed to 1 27 stun, temporarily incapacitate, or cause temporary discomfort 1 28 to a person without penetrating the person's body. 1 29 Sec. 3. Section 724.2, Code 1997, is amended by adding the 1 30 following new subsections: 1 31 NEW SUBSECTION. 8. A resident of this state, who 1 32 possesses an offensive weapon which is a curio or relic 1 33 firearm under the federal Firearms Act, 18 U.S.C. ch. 44, 1 34 solely for use in the official functions of a historical 1 35 reenactment organization of which the person is a member, if 2 1 the offensive weapon has been permanently rendered unfit for 2 2 the firing of live ammunition. The offensive weapon may, 2 3 however, be adapted for the firing of blank ammunition. 2 4 NEW SUBSECTION. 9. A nonresident, who possesses an 2 5 offensive weapon which is a curio or relic firearm under the 2 6 federal Firearms Act, 18 U.S.C. ch. 44, solely for use in 2 7 official functions in this state of a historical reenactment 2 8 organization of which the person is a member, if the offensive 2 9 weapon is legally possessed by the person in the person's 2 10 state of residence and the offensive weapon is at all times 2 11 while in this state rendered incapable of firing live 2 12 ammunition. A nonresident who possesses an offensive weapon 2 13 under this subsection while in this state shall not have in 2 14 the person's possession live ammunition.
