  1  1    Section 1.  Section 557.15, Code 1997, is amended to read
  1  2 as follows:
  1  3    557.15  TENANCY IN COMMON.
  1  4    Conveyances A conveyance to two or more in their own right,
  1  5 create except for spouses, creates a tenancy in common, unless
  1  6 a contrary intent is expressed.
  1  7    Sec. 2.  NEW SECTION.  557.15A  JOINT TENANCY.
  1  8    Ownership of real property by spouses shall be presumed to
  1  9 be a joint tenancy with a right to survivorship, unless a
  1 10 contrary intent is expressed.  
  1 11                           EXPLANATION
  1 12    This bill provides that joint tenancy with a right to
  1 13 survivorship shall be presumed for real property owned by
  1 14 spouses, unless contrary intent is expressed.
