  1  1    Section 1.  Section 330A.6, subsection 1, Code 1997, is
  1  2 amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  f.  The financial obligation of the
  1  4 municipality to the authority or to other municipalities upon
  1  5 the creation of the authority.
  1  6    Sec. 2.  Section 330A.6, subsection 2, Code 1997, is
  1  7 amended to read as follows:
  1  8    2.  After the hearing, and Within thirty days after the
  1  9 hearing on the resolution under subsection 1, the governing
  1 10 body of the municipality shall submit to the registered voters
  1 11 of the municipality a proposition to approve or disapprove of
  1 12 the participation of the municipality in the creation of an
  1 13 authority if the governing body receives a petition signed by
  1 14 five percent of the registered voters of the municipality.
  1 15 The proposition shall include a statement describing the
  1 16 municipality's financial obligation to the authority or to
  1 17 other municipalities upon creation of the authority and a
  1 18 statement listing the names of other municipalities which have
  1 19 expressed their intention to join in the creation of the
  1 20 authority.  The proposition shall be submitted at a general
  1 21 election or at a special election called for that purpose.
  1 22 The municipality shall not participate in the creation of the
  1 23 authority if the majority of the votes cast on the proposition
  1 24 are opposed to the municipality's involvement in the creation
  1 25 of the authority.  If a petition is not received within the
  1 26 prescribed time period, the governing body of the municipality
  1 27 may submit the proposition to the registered voters.  If the
  1 28 issue is not submitted to a vote and if in the best interests
  1 29 of the municipality, the municipality shall enact an ordinance
  1 30 authorizing the creation of the authority.  For the purposes
  1 31 of this subsection, the unincorporated area of a county shall
  1 32 be considered a separate municipality.  
  1 33                           EXPLANATION
  1 34    This bill adds to the items required in a resolution
  1 35 adopted by a municipality regarding the creation of an
  2  1 aviation authority the financial obligation of the
  2  2 municipality to the authority or to other municipalities if
  2  3 the aviation authority is created.
  2  4    The bill also provides for a referendum on the involvement
  2  5 of a municipality in the creation of an aviation authority if,
  2  6 within 30 days of the hearing required on the issue, a
  2  7 petition requesting the referendum bearing the signatures of
  2  8 at least 5 percent of the eligible voters of the municipality
  2  9 is received by the governing body of the municipality.  The
  2 10 ballot shall state the financial obligation of the
  2 11 municipality if the authority is created and the names of
  2 12 other municipalities which have expressed their intention to
  2 13 join in the creation of the authority.  The municipality shall
  2 14 not participate in the creation of the authority if a majority
  2 15 of the votes cast oppose the creation of the authority.
  2 16    In the absence of a petition, the governing body of the
  2 17 municipality may submit the issue of whether to join in the
  2 18 creation of the aviation authority to the voters and shall, if
  2 19 the issue is not put to a vote, enact an ordinance authorizing
  2 20 the creation of the authority if in the best interests of the
  2 21 municipality.
  2 22    The bill also provides that the unincorporated area of a
  2 23 county is considered a separate municipality for purposes of
  2 24 the referendum.
