PAG LIN 1 1 Section 1. Section 461A.15, Code 1997, is amended to read 1 2 as follows: 1 3 461A.15 USE OF PRIVATE FUNDS. 1 4 1. The commission may permit the improvement of parks, 1 5 when established, or the improvement of bodies of water, upon 1 6 the border of which such parks may be established, by the 1 7 expenditure of private funds, such improvement to be done, 1 8 however, under the direction of the commission, by and with 1 9 the consent of the executive council. 1 10 2. a. Subject to compliance with development and 1 11 maintenance plans, the commission shall enter into an 1 12 agreement with one or more private organizations to finance, 1 13 develop, and maintain one or more multipurpose trails in 1 14 public areas owned by the United States corps of engineers and 1 15 managed by the department. The agreement shall provide for 1 16 the development and long-term maintenance of a multipurpose 1 17 trail by the private organization. A multipurpose trail shall 1 18 be developed for multiple uses including, but not limited to, 1 19 foot traffic, snowmobiling, cross-country skiing, horseback 1 20 riding, and incidental uses. 1 21 b. As used in the subsection: 1 22 (1) "Incidental use" means the use of any public area for 1 23 riding horses for the following purposes: 1 24 (a) Traveling from a designated watering station to a 1 25 trailhead. 1 26 (b) Leaving a trail to rest. 1 27 (c) Allowing others to pass. 1 28 (d) Participating in an authorized field trial. 1 29 (e) Hunting at any time during a hunting season. 1 30 (f) Horse pleasure riding where a formal trail has not 1 31 been designated but where riding is permitted. 1 32 (2) "Public area" means any park, recreation area, forest, 1 33 preserve, game management area, wildlife area, or public 1 34 hunting area under the jurisdiction of the department. 1 35 EXPLANATION 2 1 This bill codifies the terms "public area" and "incidental 2 2 use" as they relate to riding horses on public lands and 2 3 trails under the jurisdiction of the department of natural 2 4 resources. 2 5 The bill also provides that, subject to compliance with 2 6 development and maintenance plans, the natural resource 2 7 commission shall enter into an agreement with private 2 8 organizations to finance, develop, and maintain multipurpose 2 9 trails. The trails are to be designed and developed for 2 10 multiple uses including, but not limited to, foot traffic, 2 11 snowmobiling, cross-country skiing, and horseback riding. 2 12 LSB 2376HV 77 2 13 tj/jj/8
